法治论坛 FORUM OF LAW 城乡规划领域公共利益及其调适 The Public Interest and the Adjustment of the Urban and Rural Planning Field 曹银涛 内容提要 公共利益是不特定多数人的利益，具有概括性、历史性、不确定性、分层次性等特征。 判定城乡规划领域的 公共利益应遵循符合与城乡规划有关的法律确定的目的及原则、公共受益性原则、不违反上位公共利益的原则、符 合实际需要等原则。 在编制和实施城乡规划过程中，涉及保护社会弱势群体利益的事项、涉及对生产要素的调配或 经济发展战略的制定的事项、涉及国防建设或防洪抗灾设施的事项、涉及保护生态环境或保护与利用自然资源的事 项、涉及城乡公共设施的事项、涉及传统文化和文化遗产保护的事项以及其他涉及以公共利益为目的事项，应当认 定为城乡规划领域的公共利益。 关键词 城乡规划 公共利益 程序 作者单位 重庆社会科学院法学研究所 重庆 400020 Cao Yintao ： Abstract Public interest is not specific to the interests of the majority, with broad, historic, uncertainty, different levels and other features. Determine the public interest of the urban and rural planning field should be guided by the aims and princi- ples confrom to the laws relating to urban and rural planning, principles of public benefit, principles of public interest, prin- ciples of practical needs and so on. In the preparation and implementation process of the urban and rural planning, the is- sues involving the protection of the interests of vulnerable groups in the society, involving the formulation of deployment of factors of production or economic development strategy, involving national defense or the flood disaster facility, involving the protection of ecological environment and use of natural resources, involving the urban and rural public facilities, involv- ing the protection of traditional culture and cultural heritage and other related issues for the purpose of the public interest, should be identified as the public interest of the urban and rural planning field. ： Key words urban and rural planning, public interest, procedure 年 月 日，十届全国人大三十次会议审议通过的《 中华人民共和 2007 10 28 国城乡规划法》（ 以下简称《 城乡规划法》 ）将公共利益写进法律并作为其核心内
