硕 士 学 位 论 文 对我国标准化法律法规体系建设的思考 Thoughts on the Construction of Standardized System of Law and Regulations in China 作 者 姓 名： 舒蜀波 指 导 教 师： 杨明成 副教授 西 南 政 法 大 学 Southwest University of Political Science and Law 2 2 1 1 2 2 内容摘要 当今世界，标准是国家和地区设置市场准人门槛的重要手段，是商品贸易全 球流通的重要基础，是技成果实现产业化的重要桥梁，已越来越成为国家和地区 综合实力的体现。谁掌握了标准的制定权，谁就占领了竞争和发展的制高点。而 我国现行的标准化法律法规体系，从标准化管理体制、运行机制和法律法规体系 本身已经不能很好地适应经济、社会发展的要求，特别是现行标准化法律法规体 系中标准化法从立法宗旨和工作任务，以及对标准与技术法规、强制性标准与技 术法规认识的不同，强制性标准的法律性质、效力来源与法律位阶不明等方面与 WTO/TBT 不能接轨，阻碍着社会主义市场经济的发展，阻碍着中国企业走向世界， 阻碍着中国融入经济全球化的进程，笔者认为应该从标准化法、技术法规、规章 和适应市场经济体制等方面加快标准化法律法规体系建设，从而促进我国标准化 事业发展、科技进步、产品质量提高和市场经济体制的完善。 Abstract In the present world, standard is not only an important means for countries and regions to set the requirements for market access, but also an important basis on which commodity trade is circulating worldwide, an important bridge to the realization of the industrialization of scientific and technological achievements, and tending to the embodiment of comprehensive strength of countries and regions. Who masters the standard-setting power, whoever occupies the commanding point of competition and development. However, the existing standardized system of law and regulations in China has already been not properly satisfying the demand of the development of economy and society in the respective of management system and operation mechanism of standardization and the law and regulations system itself, especially the matters concerning the legislation purpose and tasks of standardized law, the different understanding of standard and technical regulations, and compulsory standard and technical regulations, the legal nature of compulsory standard, the inexplicit relationship between source of effect and legal hierarchy can not be geared to WTO/TBT, which obstruct the development of socialist market economy, Chinese enterprises to the world and Chinas integration into the economic globalization.
