恩施州非物质文化遗产的法律保护分析-法学理论专业论文.docx

摘 要 中国作为拥有上下五千年文明史的大国，拥有戏曲、皮影、剪纸、舞蹈、歌 谣、神话、生产制作技艺和礼仪等宝贵的非物质文化遗产财富，其形式多样、内 容丰富、世界罕有。这是中华各民族的珍贵遗产，也是全人类的智慧结晶。它是 全国人民在长期的生活和生产实践中总结出来，并积累下来的宝贵财富。 恩施州位于鄂、湘、黔、渝边区，多年来，土家族及其先民在长期的生活和 社会实践中创造并积累了人类文明，为丰富我国的文化遗产做出了巨大贡献。然 而，工业化的推进和经济社会的发展，土家族的非物质文化遗产面临着保护与传 承的巨大压力。如何通过法律制度的健全和完善，推动恩施土家族苗族自治州的 非物质文化遗产的法律保护、权利保护、民生保障和社会发展已经成为重大现实 课题。本文立足于制度构建、健全和完善，初步探索了恩施州非物质文化遗产法 律保护的路径、功能和机制。 论文分为四章，第一章从非物质文化遗产的历史演进及概念入手，简介非物 质文化遗产的概念由来，并对其进行界定，明确非物质文化遗产的特征。第二章 慨括非物质文化遗产的法律保护，内容包括保护的现状、法理依据和国外启示。 第三章分析恩施州非物质文化遗产的保护现状，涉及到现实保护情况和法律保护 现状，进一步展示其保护成果，并分析恩施州非物质文化遗产保护存在的问题。 第四章在前文论证的基础上探讨强化恩施州非物质文化遗产法律保护的措施，从 保护原则、责任、立法和司法四个方面入手，全面保护恩施州非物质文化遗产。 关键词：非物质文化遗产；文化人权；法律保护；立法完善 Abstract As an age-old country, China has about 5000 years history, and there are many valuable intangible cultural heritages as traditional opera, shadowgraph, paper-cut, dance, sings, myth, traditional production skills and folk-customs on this timehonored land. These heritages are heterogeneous of their styles, colorful of their content, and unusual in the world. These heritages are created by every nationalities in China. These heritages are not only the treasure of China, but also the treasure of the whole world. Tujia nationality is a inland group that lives in Hunan, Hubei, Guizhou, and Chongqing provinces in China. Thousands of years, the people of Tujia created prosperous civilization, and they leave so many valuable cultural heritages. But with the development of modernization and industry in China, the protection and inherit of Tujia’s intangible cultural heritages are not a easy thing. How to advance the legal protection of Tujia’s intangible cultural heritages in Enshi by improving some correlative laws is becoming a very important problem at present.
