房地产业的宏观调控法律问题研究-经济法专业论文.docxVIP

摘要 本文主要探讨的是我国房地产业宏观调控领域中的法律问题。其目的主要 是促进我国房地产业宏观调控的法治化进程，为实现房地产业的宏观调控目标 提供法律保障，使房地产经济顺利运行。 文章首先从房地产业宏观调控的整体概念入手，对房地产业宏观调控的基 本理论进行了必要阐述，进而提出了房地产业宏观调控法治化的概念，接着又 对房地产业宏观调控实现法治化的必要性进行了论述。 随后，以税收调控、金融调控和价格调控三个方面为突破口，分别从不同 角度对我国房地产业宏观调控的法律问题进行研究。税收调控方面，以拓宽范 围，统一制度和提高立法层次为主；金融调控方面，以完善政策法规和相关配 套措施为主；价格调控方面，则以建立相关机制，补充法律缺失，借鉴国外先 进经验为主。 通过以上研究和探讨，最后得出结论：我国房地产业宏观调控中的法律问 题，必须通过长期的调适与整合，逐步将各个调控领域纳入法治化的范围，才 能得到较好的解决。而探讨和解决房地产业宏观调控法律问题的最终目的，则 是为房地产业宏观调控提供法律依据，树立其稳定性、规范性和权威性，使我 国的房地产经济能够在法律的框架内快速、稳定并健康地发展。 【关键词】 房地产业 宏观调控 宏观调控法治化 税收调控 金融调控 价格调控 法律问题 Abstract The author carries on a research on the legal issue of the macroscopic management in China’s real estate to strengthen the legal system, which supports the development of the real estate. After giving the definition of the macroscopic regulation in China’s real estate, the author introduces the basic theories of the macroscopic regulation. Then the concept and importance of the legalization in the real estate are put forward. From three aspects: tax adjustment, finance adjustment and price adjustment, the legal issues in China’s real estate is searched into. In the tax adjustment, it is the work of the first importance to widen the scope, unify the system and raise the level of lawmaking. In the finance adjustment, it is important to improve the system of laws. In the price adjustment, it is necessary to build up the mechanism, improve the system of laws and draw lessons from the foreign advanced experiences. From the research and analysis above, a conclusion can be reached: it will takes a long time to resolve the legal issues in China’s real estate through the long-term adjustment and integrations.
