武汉工程大学本科毕业论文 PAGE I 摘 要 医疗过错推定的研究对于解决医患纠纷具有重大意义，然而由于多方面的因素，医疗过错的推定往往是困难重重，其原因在于医疗过错推定理论方面还存在不足，导致医疗过错推定在具体的实践运用中存在较大缺陷，如何对这种缺陷进行有效的弥补也是当前医疗侵权领域的热门研究问题。本文通过对医疗过错推定的理论分析，结合当前我国法学界知名学者的理论研究，分析《侵权责任法》第58条的利弊，在全面剖析法律条文优点缺陷的前提下，对于完善法律条文提出一些建议，以期能对医疗纠纷的合理解决起到一点促进作用。本文首先阐述医疗过错推定的概念。详细阐述过错和医疗过错的含义，以及我国对于医疗过错推定的相关规定和历史演变过程，并和部分国外的相关规定作了横向比较。其次列出我国理论界对于《侵权责任法》第58条的评价。在理论上对法条的优缺点进行了剖析，并结合各家之言，总结出目前我国立法的缺陷。最后提出了对于医疗过错推定责任的相关立法的一些建议。主要是针对我国目前立法上的缺陷，在理论和现实的基础上，对我国在解决医疗过错的立法上提出了一些建议。 关键词:医疗过错；推定；风险分配 Abstract Medical fault presumption is the key of solving disputes, however, due to various factors, medical fault presumption is often difficult, its reason depends on the medical theory of presumption of fault are still insufficient, cause of medical presumption of fault in concrete practice in using larger defects, how to effectively make up this defect is also the current medical tort issues.This article through to the medical principle of presumption of fault in theoretical analysis, combined with the current Chinese law scholars theoretical research, analysis of the tort liability lawfifty-eighth article the advantages and disadvantages of legal provisions, in comprehensive analysis of advantages defects under the premise, put forward some suggestions to perfect the legal provisions, with a view to the medical disputes resolved in a reasonable play a role.In this paper, the concept of medical fault presumption.Detailed fault and medical fault, meaning, and our country for medical fault presumption and the relevant provisions of the historical evolution process, and some foreign regulations made horizontal comparison.The second list of our country academic group to tort law fifty-eighth article evaluation.In theory the method analyzes the advantages and disadvantages, and the combination of each character, summed up the current legislation defect of our country.Finally put forward for medical presumption of fault liability related to some legislative proposals.Mainly aimed at
