摘 要 第三部分主要分析快递服务中消费者权益受到侵害的原因。主 要原因有:首先,是快递行业的准入门槛比较低;其次,快递行业 中的实际监管者不明确;再次,快递行业本身的自律组织也不成 熟;最后,现有的关于快递立法的层次较低,缺乏专门性和系统 性。 第四部分主要是提出对快递服务消费者权益保护的完善对策。 根据上部分提出的原因以及消费者受害表现,笔者提出相对应的完 善对策。首先,要提高快递服务行业的准入标准;其次,要明确快 递服行业的监管者;再次,应成立全国性的快递行业协会加强自律 性;最后,加快《快递法》的出台以及相关法律的完善。 关键字:快递服务合同;消费者权益;快递行业协会 II ABSTRACT ABSTRACT With the rapid development of social and economic progress, China’s express delivery service industry market demand is also growing, so more and more companies continue to set up the courier service. However, the courier companies against the interests of consumers are also emerging event. In the courier service transactions, consumers in a weak position, and Chinas current laws and regulations related to more fragmented and incomplete. Due to lack of legal norms of the courier service industry, the legal effect is low, so that these laws and regulations are still not effectively resolve many disputes the courier industry, while damage to the legitimate rights and interests of consumers is difficult to get the protection they deserve. In this paper, the concept courier service contracts, rights and obligat ions of the parties to the main body of the courier service contracts are de scribed. Chinas express delivery service to practical problems in consum er rights have been infringed were analyzed, according to ask questions, a nalyze problems and problem-solving ideas, combined with the reality of the domestic courier industry, analyzes the causes of damage to the intere sts of consumers, proposed delivery management problems within the ind ustry, try to analyze the deficiencies of the current courier industry legisla tion that may exist.
