Topic Nine Agency Contract (代理与签约) The Types of Agency There are mainly two kinds of agents: (1) General agent (or commission agent)(总代理): it may be a firm or a person who acts under some degree of instructions from his principals(委托人) to sell (or to buy) goods on the best terms(最优惠的条款) obtainable. Then he charges a commission for his service under some kind of agreement or contract. (2) Sole agent (or exclusive agent)(独家代理): it may also be a firm or a person who acts exclusively for one foreign principal with sole or exclusive agency rights to sell on a commission basis certain commodities in a certain districts under some kind of agreement or contract. Besides the above two main agents, there are other types of agencies with varying degrees of authority. (1) Brokers(经纪人): who negotiate sale and purchase contract for buyers and sellers, without rights of the own in the goods. (2) Factors: who have authority to sell in their own name for principal, to receive payment, and to sell at times and prices that they consider advisable.
