II II 地方立法后评估制度研究 中文摘要 地方立法是我国社会主义法律体系的重要组成部分，其在我国的政治经济文化 生活中扮演着重要角色。然而由于立法水平的不成熟、立法缺乏前瞻性，地方立法在 施行过程中有时似乎与社会情势的发展不相协调。地方立法后评估制度是目前解决此 一困境的有效手段。所谓地方立法后评估制度是指，具有地方性法规、政府规章制定 权的国家机关委托评估实施主体，按照一定的评估程序，对地方性法规、政府规章的 合法性、合理性、实效性、协调性、立法技术性等指标进行评估，并提出维持、修改 或者废止等建议的一项活动。地方立法后评估制度的产生和发展是近现代法治发展、 成文法的滞后性、中央与地方权力博弈的结果。地方立法后评估制度的实施将能够提 高立法水平、促进和谐执法、提升公民的法律意识。目前我国的地方立法后评估还未 形成完善的制度，表现在评估主体不明确、评估程序无章法、评估指标无体系，故我 国要完善地方立法首先要完善地方立法后评估制度。 关键词：地方立法 评估制度 完善 作 者：章 挥 指导教师：章志远 III III 地方立法后评估制度研究 中文摘要 The study of Local legislative institutions and evaluation Abstract The local legislation is our country socialist laws systems important component, which plays the strong character in our countrys political, economic and civilization life.
