山东师范大学硕士学位论文 山东师范大学硕士学位论文 万方数据 万方数据 摘 要 网络商品交易的出现对已存续数千年的传统交易方式无疑是一种强烈的冲击，其便利 性与快捷性使得它在与传统交易方式的竞争中脱颖而出。它既脱离了空间的羁绊，又实现 了产销时间的无缝隙衔接，正因为如此，我国每年的网络商品交易额不断刷新历史记录， 消费者网络购买热情持续高涨，网络经济和传统经济的有效融合已经成为推动我国经济快 速发展的助推器，拉动全年 GDP 增速的牵引器。然而频现报端的网络违法案件与逐年上 升的网络购物投诉率也反映出高速发展下的不和谐音符，作为监管部门之一的工商管理机 关如何对网络商品交易实现有效监管成为一个现实问题。 本文首先介绍了网络商品交易和网络商品交易监管的相关概念和理论，分别对网络商 品交易的内涵及特性，网络商品交易监管的内涵及监管职责分析等方面进行了阐述和分 析，然后依据现实情况进行定性判定，并结合相关数据进行定量分析，阐述了目前网络商 品交易监管中存在的各类问题。主要有：法律法规体系尚未健全；多个监管部门间的执法 联动机制尚不健全；监管人员专业程度不够；继续教育工作有待完善；违法取证存在困难； 案件查处工作有待加强；对政府部门监管依赖较强；消费者维权意识和能力有待提高等。 通过研读大量关于网络商品交易监管工作开展较好国家的相关资料，认真总结了德 国、日本、美国、韩国、英国等国家的先进做法，并通过对比分析后提出监管经验借鉴， 最后，结合中国现有特色情况，提出工商管理机关在加强网络商品监管方面的建议。主要 有：推进电子商务立法，完善法律法规体系；健全多个监管部门联动机制，合力监管网络 商品交易；组建专业监管机构，加强继续教育，提高专业监管能力；加强网络违法取证工 作，加大案件查处力度；抓好平台责任落实；加快信用体系建设，提高经营者自律意识； 加强消费者教育，提高消费者维权意识和能力等。 关键词：工商管理机关 网络商品交易 监管 I 山东师范大学硕士学位论文 Abstract It is undoubtedly a strong impact the emergence of network commodity transaction mode to the traditional transaction which has been existence for thousands of years, its convenience and rapidity makes it talent showing itself in the competition with the traditional trading mode.
