第 13 卷第 2 期 湖南农业大学学报(社会科学版) Vol.13 No.2 2012 年 4 月 Journal of Hunan Agricultural University (Social Sciences) Apr. 2012 中国信托财产所有权规制的缺失及其完善 梁桂莲 (中南民族大学 法学院，湖北 武汉 430074) 摘 要：信托是委托人基于对受托人的信赖而将信托财产转移给受托人，由受托人为受益人的利益而持有、管理、 处分该财产的一种财产管理制度。由于中国财产权制度沿袭大陆法系单一所有权的理念，加之相关制度设计不健 全，信托财产权归属处于不明状态，淡化了信托财产作为物权制度的属性，损害了信托财产的破产隔离功能，扰 乱了信托法律体系内部设置。为促进中国信托业健康发展，促使信托目的的有效实现，有必要在信托概念上体现 信托当事人的财产关系，同时引入源于英美法系的信托财产所有权之精神，即双重所有权，以有效保护信托关系 人的正当利益。 关 键 词：信托财产；财产所有权；委托人；受托人；受益人 中图分类号：D922.282 文献标志码：A 文章编号：1009-2013(2012)02-0067-05 Shortage and improvement of ownership rules of China’s trust property LIANG Gui-lian (School of Laws, South-Central University for Nationalities, Wuhan 430074, China) Abstract: Trust is a system under which the client transfer his (her) property to the trustee based on the confidence in the trustee. In this system, the client uses the legal control of money or property to set up a trust, the trustee is responsible for holding, managing, and disposing the property for the beneficiary. Because China’s property system follows continental law and keeps the concept that property belongs to only one person, China’s trust property right is not clear, which trivializes trust property’s features as property system, damages the bankruptcy isolation capacity, and disturb internal order of trust law. In order to promote the healthy development of China’s trust industry and achieve the purpose of the trust, dual ownership of trust property is necessary to introduce.
