基因技术可专利对象研究 中文摘要 中文摘要 21 世纪是生物技术的世纪，越来越多的国家将基因技术这一新兴领域作为国 家发展的重要战略目标，专利制度作为保护基因技术研究开发成果的有效工具被 各国重视。本文运用比较研究、案例分析、调查研究等方法研究基因技术可专利 对象的范围，考察基因技术可专利对象的历史演变及其发展规律，总结基因技术 可专利对象与不可专利对象的界限，分析美、日、欧对于基因技术可专利对象范 围规定的态度和趋势，最后对我国已授权基因技术专利的各项数据进行统计和分 析，归纳我国基因技术专利授权的特点和暴露出的问题，从而对我国基因技术专 利制度的构建提出立法建议，即根据我国基因技术不同领域的科研实力，适当扩 大可专利对象范围，并同时提高实用性审查标准、完善遗传资源来源信息披露制 度，以期在社会公共利益和权利人个人利益之间找到平衡点，最大限度促进我国 基因技术的发展。 关键词：基因技术、可专利对象、范围界定 作 者：钱鸿良 指导教师：李小伟 I 英文摘要 基因技术可专利对象研究 Reach on the Patentable Objects of Gene Technology Abstract The 21st century is the century of Biotechnology, more and more countries regard the progress of Gene Technology which is an emerging field as an important strategic goal of national development. The patent system has been well valued as an effective tool to protect Gene Technology research and development achievements. This paper studies the scope of patentable objects of Gene Technology by methods of comparative research, case study, investigation, etc. This paper reviews the historical evolution and development law of patentable objects of Gene Technology，summarizes the boundary of patentable objects and unpatentable objects of Gene Technology, and analyses the attitude and trend of the laws on objects of Gene Technology of America, Japan and Europe. Last but not least, this paper statistically analyses the data of patented Gene Technologies of our country, sums up the features and revealed problems of our patents authorization of Gene Technology. Accordingly, the suggestions on the lawmaking of our patent system of Gene Technologies are given, which is extending the scope of patentable objects according to different scientific research abilities in various fields of Gene Technologies, as well as raising the patent utility review standards and improving the System of Disclosure of Origin of Genetic Resources, in order to find the the balance between public interests and private rights and promote the development of our Gene Technologies to the utmost.
