中文摘要交叉询问制度是英美法系诉讼中双方当事人及其代理律师对证人盘问时需 中文摘要 交叉询问制度是英美法系诉讼中双方当事人及其代理律师对证人盘问时需 遵循的规范体系。它被认为最集中地体现了对抗制庭审模式的特征。在两大法系 的互相融合大背景之下，我国于1996年对刑事诉讼法进行修改，最大的特点之 一是庭审方式引入了英美法系的对抗制因素，在证据调查方式上基本确立了交叉 询问制度。但是，受1979年刑事诉讼法确立的诉讼模式影响，一方面交叉询问 制度的具体规定、配套措施尚付阙如或不尽完善；另一方面，司法实务中对交叉 询问的认识和重视不足，致使交叉询问制度司法实务中出现一系列问题。鉴于此， 本文对交叉询问制度的理论基础、交叉询问的程序规则及配套措施以及交叉询问 的价值功能等方面进行了考察研究，在此基础上提出了构建、完善我国交叉询问 制度的建议。 文章由前言、正文和结论三大部分组成。其中正文分别用五个章节进行具体 论述。 第一章首先简介了交叉询问的概念和英美法系、大陆法系的两种证人证言质 证模式。第二章论述了交叉询问的理论基础，提出人权保障、相对理论是交叉询 问制度主要的理论基础。第三章探讨了交叉询问的程序规则及配套措施。交叉询 问一般程序分为交叉询问的顺序、交叉询问的范围以及交叉询问的方式三个部 分。交叉询问的具体规则主要有：诱导性询问规则、不得质疑己方证人规则、当 事人异议规则、传闻证据排除规则及关联性规则。交叉询问的配套措施则分为陪 审制度、辩护制度、法官制度、证人出庭作证、审前准备程序的设置五部分。第 四章对交叉询问的价值进行了评析。主要从有益发现案件真实、实现程序正义价 值、提升诉讼效率价值三个方面进行分析。第五章为文章重点，提出了交叉询问 制度在我国应如何构建的建议。首先介绍我国交叉询问的现状及对其简要评析， 其次详细论述了交叉询问制度的完善，提出了对交叉询问的一般程序、证据规则、 司法制度相关配套性措施等方面的完善。 结论部分主要为交叉询问制度的优缺点、运行现状及如何完善的建议概述。 关键词：交叉询问，刑事诉讼，证人证言质证，制度构建 中图分类号：D925．2 V AbstractCross——examination Abstract Cross——examination system is fl standard system to follow when the parties and their attorneys cross——examination the witnesses in Common Law countries．It is considered to be the most concentrated expression of the adversarial trial mode．In the background of integration between the two legal systems，our country modified the Criminal Procedure Law of China in 1996．The biggest features of the modification are that some factors of the adversarial system of common law is introduced to the trial and basically establish the cross——examine system on the way of evidence investigation．However，under the influence of the Criminal Procedure Law of 1979，on one hand the specific provisions of cross—examination system and the supporting measures are still not perfect：on the other hand，few knowledge and 1ittle attention to the judicial practice of cross—examination system causes a series of problems．In view of thiS． the paper focuses on the cross-examinat ion System theory，the procedural rules of cross—examination，the supporting measures and the value of it． And
