[争议焦点] 1.专利技术权利人与他人签订专利技术转让合同，未经权利人同意，受让人将该专利技术做了局部改进后转让给第三人，受让人的行为性质应当怎样认定？ [Case Summary] Under the Contract Law of the Peoples Republic of China, where a transferee’s exploitation of a patent or use of know-how exceeds the agreed upon scope, or, without consent of the transferor, the transferee unilaterally permits the patent to be exploited or the know-how to be used by a third party, the acts in breach of contract are to be ceased and liability for breach of contract assumed; and, where there is breach of any agreed upon duty of confidentiality, liability for breach of contract is to be assumed. Here, the patented technology owner entered into a patented technology transfer contract with a transferee permitting the transferee to use the patented technology, and it was agreed that only the transferee was permitted such use. The transfer
