《立法学》课程简介 课程代码 课程名称（中英文） 学时 学分 先修课程 推荐修读学期 立法学（Legialation） 36 36 14门法学核心课程 第六学期 课程简介： 立法学是整个法学体系的一个重要组成部分。法治和法学的产生和发展，以立法的发展和对立法的研究为前提。立法学是促进法学理论与实践有效结合的重要学科。西方主要国家将立法学作为专门学科加以研究已有一个世纪。国外对中国立法问题也相当关注。在中国，立法学还是一门新学科，立法学研究队伍有待加强，立法学著述急待丰富。 本课程教学目的是使学生掌握立法学的基本概念、基本理论、基本制度、基本技术，提高立法理论水平，学会运用立法理论和立法技术解决立法实践提出的一系列具体问题，为立法实践提供科学的说明。 本课程内容包括导论、立法的概念、立法原理、制度和技术、立法指导思想和基本原则、立法主体、立法权限、立法程序、中央立法、地方立法、授权立法、立法方法、策略和要求、立法预测、规划和决策、法案起草、法的构造、法的总则、分则和附则、立法的完善等内容。 本课程安排两次课堂专题讨论，安排两次课堂作业，以帮助学生对课程的基本知识和前沿问题有比较全面、深刻的掌握。 Brief Introduction of the course: Legislation is one of the important components of the whole legal systems. The beginning and development of the rule of law and the science of law are on the premise of the development of the legislation and the research on the legislation. The science of the legislation is the important subject that promotes the effective combination of the theory and the practice. In the major western countries, the legislation has been researched as a special subjects for over one century. The foreign countries also pay close attention to China’s legislation’s issues. In China, the science of the legislation is still a new subject. The research ranks of the science of the legislation have yet to be strengthened. The books on the science of the legislation have yet to be plentiful. The teaching purposes of this course are the following: making the students grasp the basic concepts, basic theories, basic institutions, basic skills of the science of the legislation; increase the theory level of the legislation; learn to use the theories and skills of the legislation to solve the series of specific problems aroused in the practice of the legislation; provide the scientific explanation for the practice of the legislation.
