II II Abstract As the transformation of the social economical structures and the gradual implementation of economic reformation, enterprise ownerships and employment forms are being diversified. The labor exporting from rural areas to cities leads to a community of migrant workers scattered in all kinds of works. Particularly, the government of Chinese mainland has initially established a set of migrant workers industrial injury insurance management system and a series of implementation approaches. However, the latest survey data shows that more than 95% migrant workers in the construction industry have not signed labor contracts, so that they don’t have the injury insurance. Consequently, these workers are excluded from the coverage of the injury insurance system. If the injury occurs, the migrant workers cannot be legally protected, which yields challenges of the injury insurance system. This paper has discussed the contradictions and difficulties hindering migrant building workers from being involved in the injury insurance system. First，in viewpoint of the employment characteristics of migrant workers, the importance of injury insurance system migrant workers are investigated in terms of protecting the reasonable use of their labors and their labor rights. Meanwhile, protective ability of the system is analyzed theoretically by introducing the performing mechanism of the injury insurance and the injury insurance political system. Second, the statistical materials of injury accidents for migrant building workers in Chinese mainland are analyzed. Based on the analysis results, an in-depth discussion is carried out on the reasons contributed to the current plight of the migrant building workers the building industry when injuries occurred and the problem of execution of the injury insurance system when injuries occurred, with respect to government, employers, individual workers and their associated rights, responsibilities, interests, respectively.
