中文接要摘要 中文接要 摘要 依法对金融业监管是现代法治国家依法治国的一项重要内容。由于金融业自 身具有的特殊性，使得传统的金融监管方式不能保障金融业的安全运行，对金融 业的监管必须是依法监管。但是金融业的依法监管又有其复杂性，主要表现在： 金融法律监管的主体是内国的权力部门，国际经济组织；金融法律监管的对象是 银行、证券和保险业等，各专业存在于不同的国家或国际社会；金融法律监管的 客体是各国金融制度的安全。各种金融法律监管已经形成了固定的模式即金融法 律监管机制。金融法律的监管实际上是国家权力的行使和让与，故内外国的监管， 国际经济组织的监管，都使该机制产生了各种冲突。为化解冲突，协调监管，也 是整个监管必不可少的方面。 为此，本文从以下几个方面加以论述：首先对金融法律监管的含义进行界定。 其次，从八个方面对现有的存在于各国或国际经济组织中的金融法监管机制加以 详细论述。它包括内国的金融法律监管机制、外国的金融法律监管机制和国际经 济组织的金融法律监管机制。再次，本文对在金融法律监管中存在的冲突与协调 进行深入地论述。它包括内国的金融法律监管机制、内外国的金融法律监管机制 和内国与国际经济组织的金融法律监管机制的冲突与协调。最后，本文就建立我 国的金融法律监管机帛4及解决其冲突与协调提出了立法建议。 在本文的论述中，作者以金融业的背景知识为依托，从法律上对各国和国际 经济组织的金融法律监管进行论述。论证中采用了跨专业、跨学科的综合的方法， 并用历史与现实的方法，跨国家的国别比较的方法进行论述。 关键词：金融；法律监管；机制：冲突；协调 英文摘要The 英文摘要 The mechanism，Conflict and Coordination of Supervision and control to Financial by Law Abstract To supervise and control financial system by law is one importan‘work in modern country run in law．As the financial system has a special feature in itself,the traditional way of supervision and control to financial system cannot guarantee it in a safe way SO that the supervision and control must be run in law．However,it is complex and which call be shown as follow：the subject of supervision mad control financial system by law is the power structttre ofthe state，the international economic organization；the object of supervision and control financial system by law is the banking，security and insurancing which exists in deferent countries and international society；the aim of supervision and control financial system by law is the safety of financial system in deferent countries． n措system of supervision and control financial system by law in deferent countries have become fixed moods．Supervision and control financial system by law is a mood of exercising Or abdicating power,SO the supervision and control financial system of “in-ex”state，international organization must made deferent conflicts．To overcome them．the coordinate is indispensable． Th锄：fIore，the theory includes these points in this thesis
