国际劳工标准在我国的引入与执行研究-工商管理专业论文.docx

摘 摘 要 国际劳工标准是指由国际劳工大会通过的国际劳动公约和建议书，以及其他达成国际 协议的具有完备系统的，关于处理劳动关系和与之相关联的一些关系的原则、规则。公约 与建议书的法律特征不完全相同，公约作为一种多边条约，应当经过会员国的批准，批准采 取自愿的原则：建议书旨在对各国的立法行动和制订政策起指导作用，所以是不必批准的， 因此不具有公约的法律约束。 在经济全球化的背景下，国际劳工标准的重要性日益突显，成为各国政府和学术界普 遍关注的问题，对我国的经济、贸易和劳动关系也产生了重要影响。基于这样的背景，本 文介绍了国际劳工标准，研究了国际劳工标准在我国的引入和执行情况。 文章分为四部分：第一部分是对国际劳工组织及国际劳工标准的介绍，包括国际劳工 标准的含义和内容、国际劳工标准的特点、实施和监督机制等；第二部分，阐述了在全球 化的背景下国际劳工标准和国际贸易、体面劳动、SA8000标准的关系，介绍了国际劳工 标准对当今世界的影响；第三部分重点介绍国际劳工标准在我国的引入和执行现状，涉及 到了我国和国际劳工组织的关系、对国际劳工标准的反应、适当加快批准公约的意义；第 四部分，指出了我国在执行国际劳动公约的过程中出现的问题，并就如何提高我国企业对 国际劳工标准的执行效力问题提出了对策与建议。 关键词： 国际劳工标准 劳动公约 国际贸易 SA8000 AbstractThe Abstract The International Labour Standards are the ILO Conventions and Recommendations passed by the International Labour Conventions．The ILO Conventions actually not the same with the Recommendations．As multilateral conventions．the ILO Conventions should be ratified by a11 the member parties under freewill．On the contrary，the Recommendations are only guidance for member countries’legislation and policy—making,thus they are not biding and need not be ratified． Under the circumstances of economic酉obalization，the International Labour Standards play a more and more important role and draw great attentions from governments and academes．Meanwhile，吐ley also have great influence on Chinese economy,international trade and labor relations．In this background，the thesis introduces也e International Labout Standards and its ratifications and exeoation in China． 111e thesis mainly has four chapters．Chapter One is the introduction of ILO and the International LabOur Standards，including meax血g，contents and characters of the Intemafional Labour Standards,and its execution and supervision．Chapter Two expatiates 011 the relationship among the International Labour Standards，the international trade,decent labour and SA8000．Chapter Three expatiates on the execution in China,concerning the relationship between China and the ILO，reactions to the International Labour Standards，and expedition of Chinese
