摘要IIl 摘要 IIl r r l Ii I r lTr ii ii ii iil Y1 923634 摘要 家庭教育是关乎人一生的教育。良好的家庭教育方式，能够促进儿童健康快 乐的成长，有助于儿童的生存权、受保护权、发展权与参与权得到保障。然而， 现实社会中，理念和实践的差距变大，结构性压力的增大使“教育为成人生活做 准备的理念在今日家庭教育中被前所未有地制度化、结构化和功能化。儿童被 看作家庭和家族的隶属物，成人们把自己的意志和价值标准强加给儿童，很少考 虑儿童自己的需要与愿望。 由于血缘关系这种天然的纽带，使得家庭教育在儿童成长的过程中具有基础 性的地位，而家庭教育法作为家庭教育中的特殊保护机制，必然会对家庭教育的 发展起着保驾护航的作用。目前，我国儿童的家庭法律保护正处于一种边缘化的 状态，家庭教育呈现出过度、缺乏和违法等现象。那么，针对家庭教育的现状， 是否需要建立一部专门的家庭教育法争议颇多。本文从儿童权利受保护程度的视 角出发来透视家庭教育立法，在借鉴国外家庭教育相关法律、法规以及我国台湾 地区《家庭教育法》的基础上，认为家庭教育立法并不是一蹴而就的，而是一个 漫长曲折的过程。家庭教育立法重在其成效，而不能为了立法而立法。鉴于以上 认识，笔者认为，要完善家庭教育立法的保护机制，需要从家庭教育中家长自身 理念的更新、家庭教育立法体系的完善、家庭教育法的执行监督机制以及家庭教 育的社会支持体系出发，才能维护家庭教育的健康发展，为儿童的成长提供一个 自由广阔的空间。 关键词：家庭教育，立法，儿童权利，保护机制 AbstractAbstract Abstract Abstract Family education is a lifelong education for a person’S growth．Good family education mode call promote children’S healthy and happy growth，and also can help children obtain the rights such as：subsistence right，protection right，development right and participation and SO on．However,in the realistic socie哪,the gap between idea and practice become great,the structural pressure enhanced，the conception ”education prepared for adults”is unprecedentedly institutionalized，structured and functioned．Children ale looked as family and family membership’S possession,the parents put廿1eir will and value standard 011 children,consider children’S own needs and wishes seldomly． Because of the natural kinship ties，family education has the basic position in childrens growth process．As the special protection mechanism，family education law plays the role of escort on family education’s devdopment．At present，our children’S family law protection is in the marginal status，family education shows excessive，lack and illegal phenomenons ere．In view of the situation of family education now,the dispute of establishing a special family education law is quite a lot．The paper perspective the family education legislation from the degree of children’S rights protection．On the theory basis of
