PAGE 10 - 离婚损害赔偿制度初探 周丽萍 瓯江学院 法学 06瓯法本四 0630265104 指导老师：王晗 林孟清 摘 要: 随着市场经济的不断发展,在人们的生活水平不断提高的同时,也出现了一些不和谐的音符.家庭暴力、包二奶等许多现象导致了一些婚姻家庭的破裂,并且给婚姻关系中无过错的一方带来了沉重的物质上的损失和精神上的痛苦.这些社会问题给离婚损害赔偿制度的构建提供了现实中的依据.2001年4月,《中华人民共和国婚姻法(修正案)》(以下简称现行《婚姻法》)通过,离婚损害赔偿制度作为婚姻法的一项新制度正式登上了我国法制现实的舞台.作为一项新生事物,它在理论上还不够成熟,法律条款的高度抽象化和过于简单化,给实践操作带来了许多困难,但它却代表着我国婚姻立法的实质性进步,具有重大的理论和实践意义.离婚损害赔偿制度自从在我国确立以来,有关它的理论和可操作性的诸多问题的争论从来没有停止过.本文拟对法学界关于此制度的若干争论问题进行介绍,并通过对这些见解进行分析与探讨,提出自己的观点,以期对进一步完善我国离婚损害赔偿制度. 关键词: 离婚；损害赔偿；完善 Abstract: With the development of the economical society and the living standard,there also appeared some unharmony voices in our country . Familiy violence . The Phenomenon of o ne man owns two wives,etc,led tosplit of the marriage . The splitted marriage Brought mental and substantial agonies to the either Party who 15 innocent. It just provide the actual basis of the Putting forward of the divorcing compensation institution. After the Marriage law of PRC (the amended)was passed in April 2001,a new system of the divorce damages compensation was established. As a new thing, it is not theoretically mature, and the articles are quite abstract and simple, which results in many practical difficulties. However, it symbolizes the substantial progress of our Marriage law and holds significant theoretical and practical meaning. Since the system of the divorce damages compensation was established in China, the argument about its theory and practice has never ceased. This article is about to introduce different opinions about this system, and make analysis and discussion to give my opinion which may be useful to improve our system of the divorce damages compensation.
