After more than 20 years development, Chinese FDI has grew into certain scale, istics The Chinese legal system of FDI administrafion has some drawbacks, especially in the procedure of legislation. All these backward aspects make negative effects on the activity of the Chinese enterprises in the global market. In a word，the need of reforming the Chinese legal system of FDI administration is urgent. In the process of realizing the going global policy, in order to regulate the FDI performance of Chinese companies the relevant government sectors had drawn up a series of regulations and rules. But due to some reasons, the construction of the legal system for supervising and administrating the FDI performance has not been fulfilled. Some specialized laws are not founded, and the administration level is still low. Compared with the western developed countries, the existing laws and ordinances concerned with FDI in China are mainly focusing on the administrative approval process which a company must undertake before it applies for going out. On the contrary, there are no integrated laws or regulations which provide companies the investment guidance and performance administration after their going out. Some administrative problems concerning legal issues are lack of systematic and appropriate planning, too strict on the procedure of administrative approval and without relavent laws on FDI.
