摘要摘要 摘要 摘要 纵观环境问题的形成史，也是人类发展的行为史，环境本无病，若有，也是因为 受到了人类的巨创，是人类自以为是的行为与肆无忌惮的破坏导致了环境问题的产 生，所以解决环境问题要从限制、约束、激励人类的行为入手，而制度就此应运而 生。环境问题可以说是制度性的环境问题，环境问题的根源是制度的失败，因此进行 环境制度创新是我国有效解决环境问题的出路之所在，也是有效解决环境问题的关键 之所在。那么究竟哪种制度安排最适合于现今的中国国情，究竟应该建构出怎样的制 度体系来有效的解决环境问题，原因在哪里，出路在哪里，这是本文的研究任务所 在。 本文共分四部分： 第一部分由环境问题的产生引出应当从制度的角度加以解决。 第二部分在客观分析市场、法治、科技的因素在解决环境问题过程中扮演角色的基 础上，考虑到我国的民族心理结构的因素，提出恰当的政府环境管理制度安排是及时、 有效解决我国环境问题的主要出路。 第三部分从国家环境政策与环境行政目标实现的冲突、政府环境行政的过与不及、 制度变迁中的依赖作用、环境行政主体的有限理性、环境管理体制的失衡几方面论述政 府环境管理制度供给不足的原因及表现。 第四部分提出对政府环境管理的制度创新，重构的管理制度应该是能够体现主体能 动性与制度结构刚性的互动、制约与激励共存的开放的环境管理制度，并通过统一管 理、有效运作、公众参与、手段兼容的方式进行有效的机制设计柬实现。 关键词环境问题；机制设计；政府环境管理制度 AbstractLet’S Abstract Let’S take a survey widely on the history of fomation of the environmental problem．It is also the behavior history ofhuman development．Environment is originally flawless，ifnot，it iS because of the fatal destruction of human beings．It is self-satisfied behavior and reckless destruction of human that cause the environmetatal problems．therefore，we will start with restricting、controlling and urging the human behavior to solve this problem．That is to say, institutions come into being．we carl say that environmental problem is a kind of institution problem．its problem roots in the failure of institution．So that the creation of environment institution iS the effective and key way to solve the environmental problem in china．HOW ever, which institution iS the most suitable for current condition of china,hoW to construct such system to solve the problem effectively．What can we do and how can we do?These questions Can be answered in this paper． There are four parts： I． Environmental problem causes US to make a solution from the point of institution． 1I．Based on the role which objective analysis market、law and scientific technology have played，considering the psychological structure of our nation，it is the timely and effective way to solve this problem that putting forward proper arrangement of administrative institution on environment．
