PAGE PAGE 10 本科生专业文献综述 题 目: 关于物权行为理论的文献综述 姓 名: 束丽莉 学 院: 人文社会科学学院 专 业: 法学 班 级: 法学52 学 号: 2265214 指导教师: 陆红 职称: 副教授 2008 年 6 月 20 日 南京农业大学教务处制 关于物权行为理论的文献综述 法学专业学生 束丽莉 指导老师 陆红 摘要: 德国著名罗马法学家萨维尼创立的物权行为理论,自其产生之日起就经历了或褒或贬的评判。该理论的支持者认为其保护了交易安全，维护了物权秩序；而反对者认为该理论保护了交易中的恶意第三人，有违公平和正义。物权行为理论对物权变动模式有着决定性的影响。大陆法系国家根据其对物权行为理论的接受程度选择了不同的立法例。我国新颁布的《物权法》并没有采纳物权行为理论。但是考虑到这一理论的实践价值，立法中结合我国的国情设立了通过对债的履行过程进行公示，以达到物权变动效果的独特物权流转制度。 关键词:物权法；物权契约；物权行为 A Summary of Real Right Behavior Theory Student majoring in law SHU Lili Tutor LU Hong Abstract: German renowned Rome jurist Freid-rig Karl von Savigny established the real right behavior theory. The theory has experienced the judgment which either praise or censures. The supporters think that it has protected the transaction security,and has maintained the real right order. But the opponents think that this theory has protected the third person who is malicious in the transaction,and has disobeys the equity and justice. The real right behavior theory has the decisive influence to the real right change pattern. The mainland legal system countries have chosen different vertical legal regulation according to the receptivity of real right behavior theory. Our new promulgation Reality of laws does not accept the real right behavior theory. But given the value of this theory, in the legislation we have set up a unique real right circulation system according to the condition of our country. And in this system the debt fulfillment process must be publiced to achieve the real right change effect .
