论我国传统法律文化对和谐社会建设意义.doc

摘  要 改革开放以来，我国的经济建设取得了巨大的成就，法治建设也取得了长足的进步。 但社会上仍旧存在很多不稳定，不和谐的因素；部分改革中的遗留问题没有解决，发展 中的新问题又逐渐显现出来。此时党中央正式提出了“构建社会主义和谐社会”的理念， 这是及时而正确的。 作为中国传统法律文化中独具特色的一个组成部分， 和谐”历来是人们孜孜追求的 社会理想，是中华民族传统文化的宝贵遗产。传统社会中和谐的理念及其制度实践，经 过数千年的缓慢演进与完善，已经深深植根于古代政治制度与社会生活的土壤中了。通 过挖掘传统法文化中的和谐价值理念及法律实践精华，寻找这种理念的合理内涵，考察 古代社会长治久安的原因，探寻法治发展的传统动力，必然有助于转型期中国立法与司 法的完善，为构建和谐社会提供保障和借鉴。 本文从和谐社会建设的视角对传统法律文化进行考察，试图通过发掘其中的和谐因 素为今日的社会建设提供借鉴。本文第一部分对传统法律文化的涵义进行了分析，试着 对其中蕴含的和谐价值进行阐释。第二部分论述了和谐社会建设需要与之相适应的法律 文化支撑，需要法律文化的保障。第三部分主要介绍了传统法律文化对和谐社会的启示 和价值，从思想和制度两个方面进行了分析。第四部分介绍了传统法律文化可以借鉴的 传统资源，怎样和现代社会治理相结合等。 关键词：传统法律文化，和谐社会，价值 I“ “ ABSTRACT Since the reform and opening, economic construction of China has made great achievements, the rule of law has also made considerable progress. However, there are still many unstable and disharmony factors in our society, part of the remained issues in reform did not resolve yet. New problems is gradually appearing. At this time ,the CPC Central Committee formally proposed  harmonious society concept, which is timely and correctly. As a unique part in Chinas traditional legal culture.“Harmony ”has always been a social ideal and a valuable heritage of Chinese traditional culture which has been pursued by Chinese. After several years of slow evolution and improvement ,the idea of harmony and its system practice in traditional society has been deeply rooted in the ancient political system and social life. By digging the traditional legal culture values and legal practice of harmony, looking for the reasonable meaning of the idea, trying to find a reasonable reasons for long-term stability of ancient society, exploring the reasons of the development of traditional law, It must help the legislative and judicial improvement of China which is in the transition period, and provide protection and reference for building a harmonious society.
