ABSTRACTAt ABSTRACT At present,the socialist market economy system in China has been established preliminarily and the socialist law system within Chinese characteristic is forming．As a law regulating the subjects wealth-dominating relationship over the object,law of property is one of the basic institutions regulating people’S social and economic activities．At that time，the law of property in the Republic of China era was all aCt 、ⅣitlI integrated content，rational system，vivid times’characteristic and the elements of Chinc∞traditional cultures．To study this act will be helpful for the modernization ofthe Civil law,especially the law ofproperty in contemporary China． This paper indicates that the legislating of the law of property in the Republic of China era has a deep economic,political and ideaistic background．The ThreA： Principles of the People put forward by Dr．Sun Yat-sen we”impenetrate in this law, and it held the social standard．The nationwide investigating of civil and commercial custom and the reserving of mortgage laws or institutions showed that the law of property砒that time regarded the peoples’interests and respected the traditional cuStOm．Besides。the establishment of Republic of Chinas law of property got a large-scale legal transplantation,absorbed the advantages of the foreign civil laws, kept the system and the style of civil law of Germany,and absorbed the legal system of civil laws of Japan and the other countries．Studying the law of property in the Republic of China era,balancing the relations between legal transplantation and custom respecting,social standard and fight limited，should be useful to find out the appropriate interrelated elements to modernize the law of property in China today． Key words：law of property of Republic of China legal transplantation custom modem revelation Il 前 前 言 一、论文选题的理由或意义 长期以来，我国民事法律制度是以‘民法通则》作为民事活动的基本法，辅 之以‘合同法》、‘公司法》、‘继承法)、‘票据法》、‘证券法、‘保险法》、‘海 商法等各单行法，以及最高人民法院的司法解释。但是到了20世纪末，我国 社会主义市场经济体制的建设进入快速发展时期，市场经济初具规模。尤
