I I 摘 要 摘 要 为了平衡专利权人，其它利害关系人，社会公众等各方之间的合法利益， 保证专利授权的质量，世界许多国家都建立了专利权无效宣告制度，这种制度主 要有两种模式，一种是行政模式，一种是司法模式，几个主要发达国家都是采用 司法模式，我国专利权无效宣告制度是一种行政模式，这种模式具有一定的准司 法特点，这一定程度上造成我国专利权无效诉讼效益的低下。在目前我国专利权 无效宣告决定的司法审查制度中，专利权无效诉讼被认为是行政诉讼的一种类 型，并给专利权侵权诉讼带来了不便。专利权实质上是一种私权，专利权作为一 种特殊的财产权，有其特殊性。若将专利权无效诉讼的性质界定为民事诉讼，以 专利权无效宣告的双方当事人作为在救济程序中的当事人，建立知识产权法院， 对解决专利权诉讼效益的低下具有重要意义。 关键词：专利权无效宣告，司法审查，知识产权法院 II II Abstract Abstract In order to balance the patent holder ,other interested party and the social public legal interests, guarantee the quality of the patent authorization, various countries have established declaration system of the patent invalidation, this kind of system mainly has two patterns, one is the administrative pattern, the other is the judicial pattern, most of developed countries use the judicial pattern, in our legislation the announcement system of patent invalidation is the administrative pattern. This makes efficiency of litigation of patent rights invalidation very low. This kind of pattern has alike judicial characteristic. Now in the judicial review system of announcement procedure of patent invalidation, the patent invalidation litigation was considered as one type of the administrative litigation, and bring inconvenience to infringement actions, according to that the patent materially was one kind of property, as a special property right, patent right has its particularity.the patent invalidation litigation is defined as the civil action, treat the parties in patent invalidation as the parties in the remedy procedure, establish the intellectual property rights court, this is the significance of solving the low efficiency of patent right litigation.
