Prof. Zhou Guowen Specialty：Criminal Law College of Law of Chongqing University, Chongqing, China October, 2013 重庆大学 重庆大学硕士学位论文 中文摘要 I I 摘 要 医务人员拒不救治危重病人的行为在现今社会频繁发生，具有巨大的社会危 害性。目前学界只是在见危不救的入罪进行了详细的探讨，却没有对拒不救治行 为的入罪提出一个共性的方案。笔者从拒不救治行为频繁发生的现状入手，从该 行为出现的社会原因、该行为入罪的必要性与可行性方面进行分析来提出在我国 刑法中新增“拒不救治罪”的构想。其中包括了本罪的构成要件以及刑罚设置的 具体内容介绍。 医务人员拒不救治行为反映的是职业道德的丧失、是刑法对法益保护的漏洞。 笔者主张在刑法谦抑原则的指导下设立拒不救治罪，把该行为纳入刑法的规范体 系，从而缓解社会的信赖危机，减少该行为的社会危害。 在设定新罪名的同时，笔者针对我国的医疗救助制度存在的问题提出了几点 建议，以求通过制度的完善保障法律有效的实施。 关键词：拒不救治，犯罪化，犯罪构成，医疗救助体系 重庆大学 重庆大学硕士学位论文 英文摘要 II II ABSTRACT The conduct of refusing to treat seriously injured patients occurs frequently in the society. It has the serious social hazardous nature. The numerous scholars just discuss the incrimination of the behaviors of seeing the danger but not to rescue, but they do not form the unified opinion to establish a new accusation about the behaviors of refusing to treat. I want to analysis the present situation of the conduct, the occurrences of the behaviors have many social reasons, and I narrate the necessity and feasibility of establishing a new accusation. The idea includes crime constitution theory and penalties of the new accusation. The conduct of medical staff refusing to treat severely injured patients reflects the disqualification for occupational ethics and the loophole in the criminal law. Refusing to treat should be punished in order to alleviate the societys moral crisis and reduce the society hazardous nature. In the end I raise the idea that since there are problems and shortcomings in the current medical assistance system, it is essential to take effective measures to further improve medical assistance system and achieve the goal that all the poor people can be under the basic health protection.
