摘 摘 要 摘 要 虚拟财产依存于网络空间，它是计算机技术发展的产物。虚拟财产具有价 值性、能为人所支配，在现实中存在着大量的虚拟财产的交易，也出现很多种 关于虚拟财产的纠纷，需要我们予以解决。对虚拟财产予以法律保护确有其现 实必要性。我国虽然对虚拟财产有一定的研究，但对虚拟财产法律保护的现状 还不容乐观，不能与网络技术的发展相适应。目前，对虚拟财产予以法律保护 的难点首先是对虚拟财产的定性。在理论界有肯定说与否定说之分，而肯定说 又有物权说、债权说、知识产权说、无形财产权说等诸多分类。本文试图就虚 拟财产的法律保护问题作以探究，以期为解决有关虚拟财产的纠纷、促进网络 经济的更好发展贡献微薄之力。 本文分为五大部分。首先，笔者对虚拟财产予以界定，探讨其概念、特征 和表现形式，分析现实中出现的有关虚拟财产的纠纷，考察对其予以保护的必 要性；其次，通过考察中外对虚拟财产的法律保护，分析虚拟财产法律保护的 困难之处；在文章的第三部分，笔者重点讨论了虚拟财产法律保护的难点—— 虚拟财产的定性，通过对既有观点的比较分析，笔者认为虚拟财产应当是一种 新型财产权——虚拟财产权；随后，笔者从民法、刑法、行政法三个方面讨论 了对虚拟财产的法律保护，重点是对虚拟财产的民法保护，主要有物权保护、 债权保护、知识产权保护；最后，笔者就关于虚拟财产的立法提出建议，在目 前的情况下，应当采用立法解释的方法，将虚拟财产纳入公民的“其他合法财 产之内。 关键词：虚拟财产 虚拟财产权 法律保护 立法解释 AbstractAbstract Abstract Abstract Virtual property,which dependent on cyberspace is the product of computer technology development．Virtual property has valuable and call be dominated by man， in reality life there are lots of virtual property transactions，and also many virtual property disputes，need US to solve．The legal protection of virtual property is the real necessity． Although our country has sortie studies on the virtual property,but the status of legal protection of virtual property is not optimistic，can not adapt to the development of network technology．Now,the first difficult points of the legal protection of virtual property is the quality of virtual property．In theory hori zon there are sure and denying，but sure that there are property rights that claims that intellectual property rights that the classification of intangible property rights that SO many． This article attempts to explore the legal protection of virtual property issues，in order to resolve the disputes relating to virtual property,and promote the development of network economy and better contribute to modest．This article is divided into five parts． First of all，I defined the virtual property and explore its concept，characteristics and pattern of manifestation，to analyze virtual property disputes in real life，to inspect the necessity of protect them． Second
