摘要1998年7月17日，罗马外交官大会通过了具有划时代意义的《国际刑事法 摘要 1998年7月17日，罗马外交官大会通过了具有划时代意义的《国际刑事法 院罗马规约》，2002年7月1日规约开始生效，国际刑事法院正式建立，由此， 国际刑事司法进入一个新的历史时期。《罗马规约》的核心就是国际刑事法院的 管辖权问题，这也是罗马外交官会议争论最多，也最激烈的议题。为此，深入 研究国际刑事法院的管辖权和密切关注国际刑事法院的运作，无疑具有重要的 政治意义和法律意义。 除引言、结语外，本文共分为五个部分，结构和内容安排如下： 第一部分“国际刑事法院管辖权的概述”，概括性地说明了国内刑事管辖向 国际刑事管辖转化的原因，分析了国际刑事法院管辖权的基本属性，并指出国 际刑事法院管辖权行使的法律依据。 第二部分“国际刑事法院管辖权的范围”，除对《罗马规约》规定的犯罪背 景、历史演进及各类罪的构成进行逐一的分析外，还对应当纳入《罗马规约》 管辖范围的几种罪进行了探讨。 第三部分“国际刑事法院管辖权的行使”，论述了国际刑事法院管辖权行使 的先决条件、启动机制和国际刑事法院管辖权的例外，对《罗马规约》在国际 刑事法院管辖权行使方面的规定中有可能出现的漏洞进行了分析。 第四部分“国际刑事法院管辖权的效力”，运用穿插比较的方式，分析了国 际刑事法院管辖权特有的时间效力和空间效力。 第五部分“实现国际刑事法院管辖权应协调的关系”，剖析了联合国安理会 和国家主权与国际刑事法院管辖权之间的联系与冲突，在此基础上提出了一系 列改进意见，以促进国际刑事法院管辖权的顺利实施和保障国际刑事法院司法 的独立和公正。 关键词：国际刑事法院；管辖权；管辖权范围；管辖权行使：管辖权效 On On the Jurisdiction of the International Criminal Court Abstract On July 17th，1998，at the United Nations Diplomatic Conference of Plenipotentiaries on the Estat}lishment of an Intemational Criminal Court (UNDCPEICC)held in Rome，Italy，the Rome Statute ofthe International Criminal Coug(RSICC)of historic significance was voted through with an overwhelming majority．wim the Statute coming into force on July 1st，2002，the International Criminal Court(ice)was formally established，and the intemational criminal justice has come into a new era．The core of RSICC is the issue of the ICC’S jurisdiction， which was the most controversy subject at the UNDCPEICC．Therefore，paying more attention to the RSICC，especially furthering the study into the ICC’S jurisdiction and focusing closely on its operation，is still of great political and legal importance． Except Introduction and Conclusion，the thesis was divided into five parts，the arrangement of structure and content is as follows： Part one，“Generalization of the ICC’S Jurisdiction”，concisely elaborated the reasons for the transition from domestic criminal jurisdiction to intemational criminal jurisdiction，analyzed the fundamental nature of the ICC’S jurisdiction，and pointed out the legal grounds for the exercise o
