内容摘要刑罚执行监督是检察机关对刑事诉讼活动进行监督的重要职能之一。不 内容摘要 刑罚执行监督是检察机关对刑事诉讼活动进行监督的重要职能之一。不 少学者、司法工作者对有期徒刑、无期徒刑、死刑执行的监督作了深入的探 讨，但对于我国刑罚体系重要组成部分的财产刑罚执行的监督却缺乏足够的 关注。近年来，随着财产刑罚在实践中适用的比例增大，财产刑罚执行中出 现许多违法违规现象，使得财产刑罚的执行极不理想，直接影响到刑罚目的 的实现和刑罚执行制度的严肃性。当前我国财产刑罚执行体制不完备、审判 执行合一是造成财产刑罚执行混乱的主要原因，而立法对财产刑罚执行的监 督基本没有触及也是造成财产刑罚执行违法违规多的重要原因。加强和完善 对财产刑罚执行的检察监督是当前检察机关重要工作目标之一。改革当前刑 罚执行体制、完善财产刑罚法律规定、完善检察监督立法、提高检察人员素质是 加强完善财产刑罚执行的检察监督的重要途径。 本文分三章：第一章对财产刑罚执行检察监督进行概述，第二章论述当 前财产刑罚执行检察监督的存在问题；第三章提出完善财产刑罚执行监督的 设想。 关键词：刑罚执行财产刑罚执行检察监督 AbstractIt Abstract It is an important function for the procuratorate that the procuratorate supervises over execution of punishment in the process of criminal proceedings．Many scholars and judicial officials have discussed the supervision over execution of fixed-term imprisonment，life imprisonment and death penalty．However,many scholars and judicial officials did not pay attention to the supervision over execution of property punishment． Recently,many lawbreaking occurred when the property punishment was widely adopted．It influences the stateliness of punishment．The problem results in the imperfect system of execution of property punishment and the imperfect system of procuratorial supervision over execution of property punishment．To improve supervision over execution of property punishment， we must reform the system of punishment execution，amend the law on property punishment，amend the law on procuratorial supervision and improve the quality of prosecutors． The dissertation includes three chapters：chapter one is to summarize the procuratorial supervision over execution of property punishment． Chapter two is to discuss the flaw and condition of the procuratorial supervision over execution of property punishment．Chapter three is to give some suggestions to perfect the procuratorial supervision OVer execution of property punishment。 Key words：execution of criminal punishment，execution of property punishment，procuratorial supervision Ⅱ 前 前 言 刑罚执行监督是国家赋予检察机关的一项重要法律监督职能，是刑事诉讼监 督的一个重要组成部
