提要医疗纠纷分为医疗过失和非医疗过失纠纷。在民事诉讼中主要是因医疗过失 提要 医疗纠纷分为医疗过失和非医疗过失纠纷。在民事诉讼中主要是因医疗过失 引起的损害赔偿纠纷，因为适用法律规定的不同，分为医疗事故和医疗差错。医 疗事故适用《医疗事故处理条例》(以下简称《条例》)，而医疗差错适用《民法 通则》及《最高人民法院关于审理人身损害赔偿案件适用法律若T阔题的解释》。 《条例》是行政法规定，其适用限额赔偿原则，而《民法通则》则是全额赔偿原 则。因为相同的医疗行为引起的损害结果，因损害程度不同而适用不同的法律， 导致损害程度轻而获得赔偿多、损害程度重而获得赔偿少的处理结果，使当事人 对医疗纠纷民事审判不满，司法权的权威性减弱。 本文通过对医疗纠纷案件审判实务中存在的阔题的介绍，指出在我国现行医 疗纠纷案件审理过程中尚存在以下问题：1、医疗事故和医疗差错法律适用差异 议及矛盾；2、鉴定闯题；3、医疗事故与医疗差错赔偿标准不统一1问题。立法完 善的方向：1、制订专门的医学立法；2、统一鉴定、统-‘标准“3、建立医疗风 险强制保险机制，以调节和解决医疗纠纷。 主题词：医疗纠纷 医疗案件审理 医疗侵权责任 ABSTRACTMedical ABSTRACT Medical dispute can be divided into medical negligence disputes and medical disputes witll no elTOE Among ci,51 lawsuit．10ts of medical disputes arc caused by negligence，which include medical accident and medical error according to different provision prescribed in different Law．Medical accident is applied to(Regulations on Handing Medical Accident》(called Regulations for short hereafter)，while medical error is applied to((the General Principles ofCivil Law))and{Interpretations on Issues of Law Applicable to cases of Compensation for Personal rnjury by the Supreme People’S Court))Regulations belong to Administrative Law and follow the principle of limited compensation，contrary to(the General Principles of Civil Law))which following the principle of full compensation In the situation of medical treatment causing damage，different law will be applied if the damage is different．The result is that person who suffers light damage could get more compensation than one who suffers grave damage．This result dissatisfies the parties in civil lawsuit extremely and injures the authority ofjurisdiction． This dissertation aims at pointing out the problems existing in hearing the medical disputes cases．Firstly,it is the problem in procedure．The disunity of registering the brief of case，difficulty in confirming defendant,disanity of allotting the burden ofproof,multipolar appraisal and Medical Association’S medical appraisal failing the demand judgment ale the real
