摘要 摘要 患者的知情同意权是伴随着人权运动的发展、个人意识觉醒，在医患关系 和传统的生物医学模式逐渐转变的过程中成长和发展起来的。作为医患关系中 患者最基本的权利，它的含义是患者在接受医疗行为的过程中，有知晓一切可 能与其利益相关的医疗倍息，并依此为根据，在充分理解的前提下，做出符合 其根本利益成符合其意志的判断和选择。知情同意权和患者的尊严、个人权利 和利益密切相关，对于患者权利的保障和构建和谐的医患关系有着重大影响。 目前在我国，立法上对知情同意权的保护仍不够完善，相关的研究也较为缺乏， 这也是笔者以此为论题的原因。本文除引言和结论外，共分五个部分。 第一部分主要论述了患者知情权的概念和不同的学界观点、分析了患者知 情同意权的形成的原因和在各国的发展，并对患者知情权的性质进行了探讨. 第二、第二部分从患者和医师两个角度对患者知情同意权的行使进行了论 述。其中第二部分主要说明了权利行使的主体包括患者本人及其代理人，代理 人代为行使权利的范围和限制:权利行使的方式和有效要件。第三部分从医师 角度说明了医师告知义务的标准:告知的内容和范围. 第四部分对侵害患者知情同意权的法律责任进行的论述。包括对侵害患者 知情同意权的行为性质进行分析:侵害患者知情问意权法律责任的构成和免责 事由。 第五部分分析了我国立法在患者知情同意权保护中存在的不足及主要问 题，并尝试从完善立法体例、完善患者知情同意权的保护内容等方面入手，提 出完善我国相关立法保护的建议。 笔者希望通过以上对患者知情同意权的初步探讨和研究，能对完善我因此 项法律制度，充分保障患者权利，促进社会和谐有所帮助。 关键词:知情同意权告知义务立法完善 G 11 11 Abstract Abstract 币le infonnedωnsent rights of Patients grows up and develops gradual1y companying wi也 the development of the human rights and awakening of individual ω.nsciousness in 也e process of change of doctor-patient relationship and the traditional biomedical model .As the most basic right of patient in the doctor-patient relationship ，it means that the patient who is receiving medical activities has right ωbe infonned an泸hing possibly about medical information related to patients rights and interests ，in terms of which the patient makes judgment and choice in accordance with his fundamental interests and will under the premise of sufficient ∞mprehension. 叽le informed consent righ臼 of Patients closely relat叫 ωpatients r出pect，individual rights and int町ests plays an important role in protection of patients rights and construction of hannony doctor-patient relationship.
