II II Abstract Along with the development trend of population aging for the elderly crime has gradually entered the field of criminal law is widespread concern. Identification and control as a special group in the society, the elderly, mental and physical will be changing dramatically increase with age, level of intelligence and degraded, debilitating physical and mental, these have a direct impact on the elderly behavior so that it was weakened or even lost. But our existing criminal law provision for elderly crime is still very scarce. In this article, the author argues the characteristics of crime in elderly and the elderly crime excusable basis, and lists the current dispute involving the responsibility of perpetrators of elderly and comment on them, and then two in the criminal law and procedure perspective of the elderly crime of criminal responsibility to give gently recommendations put forward in the criminal legislation, will be elderly crime lenient punishment provisions in the General Principles of criminal Law; elderly crime does not apply the death penalty and suspended for the applicable moderate relaxation; conditions on the execution of the penalty for the elderly method mercy and appropriate relaxation of the application of commutation and parole conditions for the elderly, place and manner of implementation of the criminal penalties for the elderly be treated differently, with a full legal compassionate situation.
