I I 立法语言规范化的研究 中文摘要 法学研究者对语言的关注是从上个世纪开始的，有关学者在他的研究中借用 了语言哲学的理论，并根据这些构建了一个自成体系的法律王国。语言的转向给 之后的法学研究者指向了一条新路径——语言学的研究路径。法学研究的开始是 以语言为对象、研究语言和法律的关系、用语言学理论来分析法律活动，法律语 言学由此产生了。我国对立法语言的研究是从 20 世纪 70 年代末 80 年代初开始 的，大多数是以语言学的理论体系为框架，逐步构建立法语言的体系。随着研究 的不断深入，语用学和语义学理论也越来越引起学者的关注，立法语言研究似乎 在向着语用学和语义学的方向发展。从语用和语义的角度，根据维特根斯坦和奥 斯汀的日常行为理论研究立法语言的准确性与模糊性，虽然取得了一定的成果， 如对立法语言确定性与模糊性的辩证认识，对两者相互作用的理解或对模糊语义 词语的肯定等等，但没有从根本上解决立法语言失范的问题。 本文从立法汉语言的基本内涵和外延入手，主要从立法语言的现状问题进行 分析，分析立法语言的失范现象并对其进行了总结，并且对外来语进入我国立法 语言的标准进行初探，旨在探求建构良法的语言路径。本文以实证法从国家正式 颁布的现行法规、报刊杂志的司法案例中选取了典型的材料，综合运用语义分析、 语法分析、语体分析和语用分析等方法概括出立法语言词汇、句式和语体风格特 点，并就此展开对立法语言的规范化的讨论。 关键词：立法语言 词汇 句式 语体风格 规范化 II II Study on the standardization of legislative language Abstract The researchers for the attention of law language began in the last century, Hart in his research borrow the philosophy of language theory, and thus build their own systems of law kingdom. From a pragmatic and semantic theory, according to the daily behaviors of Austin and Wittgenstein theory research and the accuracy of legislative language fuzziness, although they had made some achievements, such as the uncertainty and fuzziness of the dialectical understanding of both the understanding of the interaction, the affirmation of the words of fuzzy semantics, and so on, they did not radically solve the problem of anomie
