I I 摘 要 民事保全这种事前防御损害及临时性实现权益特性的措施为各国所提倡并 在各国制度中都得以体现。但是在制定相关的条文立法时，大多围绕着保全措 施的有效性方面就事论事般地做文章，一直在避开民事保全作为一项程序而理 应具有的程序正当性问题。而这其中又牵扯到许多因素，包括在当事人和法院 在程序中的地位和作用如何界定；是单方参与审理结构还是对审结构；听审制 度如何适用；保全措施的执行如何才能更为彻底；救济方式如何设定才是合理 的等等。民事保全作为诉讼的附属程序，不论在作用上还是程序特征上都有不 同于诉讼之处，因而即使是相同的正当性程序要素，在论述民事保全程序的具 体问题上也衍生出不同的内容。 因此，本文首先先行介绍了民事保全的基本内容、作用和性质；其次，是 对正当程序作了简单的阐述，并且确定了作为民事保全正当程序的基本要素； 第三，结合上部分提到的基本要素确定民事保全程序在审判阶段应有的程序性 要求；最后，作为对第三部分的承接，论述了保全裁定的执行和救济，从而构 成整个民事保全程序的正当性探讨。 本文运用了比较法学和分析法学的方法，在正当程序理论的支持下，结合 各国具体的制度，从理论探索出民事保全审判、执行以及事后救济方面的程序 正当性要求，为日后更好的理解和运用民事保全程序打下了基础。 关键词：民事保全，正当程序，民事诉讼，财产保全 II II Abstract The civil preservation aiming at preventing damage beforehand and achieving rights and interests temporarily has been advocated by many countries and reflected in their legal system. But when formulating related articles and laws of the civil preservation，most nations put emphasis on its effect not attach importance to its legitimacy of the procedure. The enactment involves many factors，including how to define the respective status and function of the court and the litigants in the civil preservation；the court in the procedure which should be one-sided participation or confrontation；how to have the court hearing system functioned,；how to implement the preservation measures；and how to make methods of remedy，etc. As a affiliated procedure of litigation，the civil preservation have some differences from litigation in function and procedure features. Therefore，even the same factors of legitimate procedure will generate diverse contents in stating detailed problems of civil preservation procedure. Firstly，this article introduces the basic content，function and quality of the civil preservation；Secondly，it gives a brief introduction to the due process and confirms the basic factors of the due process of civil preservation；Thirdly，the article determines the procedure requirements of civil preservation procedure in the stage of trial；Lastly，it argues the implementation of pre
