II II 值作如下分类：宪政群体价值与宪政个人价值；宪政形式价值与宪政实质价值；宪 政规范价值与宪政社会价值；宪政手段性价值与宪政目的性价值。 根据上述宪政价值特征和宪政价值形态，宪政价值取向可概括为三方面：宪政 价值目标取向、宪政价值实体取向、宪政价值程序取向。在本文第四部分详尽阐释 了这一问题，指出宪政价值目标取向为人的自由而全面发展，人的自由而全面发展 其主体是个人也是一切人，它以自由为内核，是动态的全面的发展。其次，宪政价 值实体取向为人民主权，包括三个方面的价值内涵：人民主权是主观性和客观性的 统一，根源于一定历史阶段的社会政治观念和物质利益关系；人民主权是理想性和 现实性的统一，在不同的条件下有具体的表现形式；人民主权是理论性与实践性的 统一，是宪法精神的高度抽象，其价值内涵由宪法在实践中不断丰富创新。第三， 宪政价值程序取向为：权利—权力秩序。这一程序是以权利为国家本源和主导的秩 序模式，是以权利制约权力的秩序模式，是以权力互相制约的秩序模式。 探寻宪政价值本质、特征、形态和取向，最终还要实现宪政价值的整合，现代 社会宪政价值的整合要求集中体现为“宪法主治”，鉴于篇幅所限，本文在最后一部 分概括了“宪法主治”的最基本要求，即增强宪法意识，完善宪政制度，完备宪政 程序。认为“宪法主治”是一项宏大的社会政治法律工程，只有通过宪政体制内各 个因素的有机结合，互相促进，这项工程才可能取得预期的民主政治效果，也才能 在宪政实践中完成宪政价值的整合。 关键词：宪法 宪政价值 价值取向 III III Abstract Constitutionalism is an important concept in the developing history of politics and law. We can define it that having perfect constitution as precondition, constitutionalism can make restricted national power and protected civil rights reality by founding limited government on the basis of law and democracy. It is logical to say that constitution is the base of constitutionalism. No constitution, no constitutionalism. Only when the value-tropism of constitution is accord to the be-all and end-all spirit of constitutionalism, is it possible to realize constitutionalism. As for constitution, constitutionalism is the soul, and if there exists constitution in one nation without corresponding series of constitutional system, the lists of constitution will have no value. As law document, constitution belongs to society criterion, and as the practice of constitution in the real life, constitutionalism belongs to system and experience. Establishing one constitution conforming to the spirit of constitutionalism is the first and crucial step to realize constitutionalism.
