内容摘要：刑罚的功能涉及到很多方面，对它的认识、分析、评价，不仅关系到刑罚理论体系的科学性，而且影响到刑罚实践的有效性，特别是涉及国家刑事政策的正确性。所以研究刑罚的功能至少具有以下几点重要意义：首先，有助于建立现实、合理而且有效的刑罚体系；其次，国家刑罚权与公民人权在一定程度上存在着矛盾性，正确处理人权与刑罚权的基础在于刑罚功能的理性化；最后，研究刑罚功能有助于建立运用刑罚控制犯罪的现实思想，有助于国家调整刑事政策方向，摆正刑罚在社会综合治理中的合理位置。 据此，本文从刑罚功能理论入手，分析了报应主义刑罚功能理论和功利主义刑罚功能理论，对国内外传统的和现当代的与刑罚功能相关的理论作了简单的评价，指出了其存在的价值性和存在的一些缺陷，通过对这些理论进行分析，个人认为刑罚的功能不能只强调绝对正义而不关心社会利益和个人利益，或只强调社会利益，社会价值而漠视个人利益和个人价值，刑罚功能应该是在维护正义，社会利益的同时充分重视个人的利益和价值的，能将正义、社会和个人的要求合理的统一起来。本文还据此从直接和间接的角度出发，提出了对刑罚功能新的分类，即将刑罚功能分为直接功能和间接功能。　 关键词：　刑罚功能　　报应主义　　功利主义　　直接功能　　间接功能　 Abstract ：The penaltys function involves very various. Understanding, analyzing and evaluating it affect not only the system of scientific penal theory, but also the effective practice of penal, specially the correctness of the government penal policies.
