四川省高等教育自学考试法律(D030106)专业 毕业论文 论文题目 试论担保型买卖合同 指导老师 X X X 学生姓名 X X 准考证号 XXXXXXX 2016年8月 担保型买卖合同研究 专 业：法律(D030106) 学 生：XX 指导教师：XXX 摘 要：我国的司法实践中目前存在着以买卖合同为借贷合同进行担保的新型担保形式，借贷关系的当事人或其关系人在借贷合同之外再签订一份买卖合同，口头约定如不能按期偿还借款，则执行买卖合同，将买卖合同的标的物转让给出借方，以房屋抵债。在民间借贷活动当中，此类担保型买卖合同所引发的纠纷也日渐增多。这种新型担保物权与让与担保产生的背景和发展过程基本一致，应当确认这种习惯法上的非典型担保物权，并对其进行规范，使其能够更好地为经济发展服务，为企业的融资进行担保，以发挥其应有的作用。本文通过对此类担保型买卖合同的本质及其效力进行研究，对此类担保型买卖合同做一个探讨与还原。 关键词：担保型买卖合同；后让与担保；非典型担保物权 ABSTRACT Nowadays in practice Chinas judiciaiy exsists a new guarantee modality which are using the sales contract to guarantee the contract of loan. Parties or other privies who have the credit realationship will sign an extra sales contract when they sign the contract of loan. They reached a verbal agreement that if the borrowers can not pay the bill on time, the lenders will carry out the sales contract when the borrower should transfer the possession which the sales contract lined out, slovent by their house. In the informal credit activities, the dispute by this kind of garantee sales contract is increasing day by day. The process of this new guarantee form of material right and its backgrand and development are almost the same, This non-typical guarantee form of material right should be confirmed and regulated to make sure it serves the economy bettter and plays its own role like securing the corporate finance. This article is aimed for by studying the nature and potency of this kind of guarantee sales contract to make a discussion and restore of it.
