PAGE 论文编号： 论文编号：200800214208 论我国公民的迁徙自由权 院系名称：政法学院 班 级：法学082 学 号：200800214208 学生姓名：李楠楠 指导教师：张冀鹏 2012 年 6 月 中原工学院2012届法学专业毕业论文 论我国公民的迁徙自由权 PAGE 6 中文摘要 迁徙自由权作为一项基本人权，对我国经济的发展、民主的进程以及履行国际公约都起着至关重要的作用。无论是联合国有关人权约法，还是当今世界多数国家的宪法，迁徙自由权都作为一项内容而被明确规定。 然而迁徙自由权在我国因经济、政治原因从1975年宪法中被取消后，一直没有恢复其合法地位。同时，我国专家学者对迁徙自由权重新入宪的态度也并不一致，尽管出台了一系列的规章制度对迁徙自由权已经相对认可，但是在宪法层面上，迁徙自由权仍是空白。 近年来，随着我国市场经济的建立和发展，以及人口的大量迁徙流动，迁徙自由权日渐升温，它对解决当前各大城市外来人口的安置起到了积极的作用，但是由于宪法层面上的缺失，我国并没有形成真正意义上的人口自由迁徙，这也再次引起了人们对迁徙自由权重新入宪的思考。 对此，笔者不揣浅陋，以论我国公民的迁徙自由权为题撰写论文，从迁徙自由权的基本问题入手，对其进行概念阐述、国内国外的现状分析，并结合我国迁徙自由权重新入宪的现实分析，提出了对迁徙自由权重新入宪的几点构想。笔者希望能通过以上的分析，对迁徙自由权进行一番较为系统和全面的探讨，并能够促使我国的迁徙自由权早日纳入宪法。 关键词：迁徙自由权，市场经济，户籍制度 Abstract As one of the basic human rights, the right of migration freedom played a crucial role in our country’s economic development, democratic progress and the implementation of international convention. It was explicitly stipulated as content in related human rights provisional constitution of the United Nations and constitutions of most countries in the world. But in China, migration freedom hasn’t been resumed its legal status since the 1975 Constitution was cancelled for economic and political reasons. Meanwhile, our exports and scholars’ attitudes toward building the right of migration freedom into the Constitution were not entirely consistent. It was relatively recognized by a series of regulations that were launched, but in the constitution level, right of migration freedom was still blank. In recent years, with the foundation and fast development of market economy and the large number of population migration, migration freedom became more and popular. It made positive contribution to solve the resettlement of floating population in current major cities. But due to the absence of constitution level, our country hasn’t formed free migration in its true sense. This caused people’s thinking about rebuild the right of migration freedom into the Constitution.
