摘 要 摘 要 互联网技术的诞生和发展，为各种信息的取得和传播提供了便利条件，直接改变和 影响了人们的生活方式。但是随着网络信息的随意发布，网络谣言问题也日益严重。网 络谣言与传统谣言不同的是其本身具有传播主体匿名、传播速度快以及数量大、难辨真 假等特点，因此与传统谣言相比较，它所造成的危害会更大，给我们的生活、社会以及 国家造成了巨大影响。在我国网络谣言的法律治理中，还存在着法律规范体系不完备、 执法机制不健全等弊端，因此要完善对网络谣言的法律治理，是一件十分紧迫的事情。 本文对网络谣言的基本概念进行阐述，并在此基础上梳理网络谣言的相应特征及规制的 必要性，从我国治理网络谣言的法律规定现状分析不足之处。对国外网络谣言的法律治 理进行分析并总结经验，然后予以借鉴，并对我国网络谣言的法律治理提出合理建议。 本文共分为五个部分。 第一部分，网络谣言概述。阐述了网络谣言的概念、法律认定标准以及其分类和特 征，并在此基础上分析规制网络谣言的必要性。网络谣言概念的学术界定，存在广义和 狭义之分。具有危害性的网络谣言不仅影响个人名誉，带给个人经济损失，还可能会造 成社会秩序混乱，网络谣言的传播给国家、社会和个人都造成了很大的危害。 第二部分，我国网络谣言法律治理考察。通过系统分析我国现有关于治理网络谣言 方面的法律规定，指出相应的不足之处：规制网络谣言的法律规范体系不完备、执法机 制不健全、网络造谣行为追责机制不完善。 第三部分，域外网络谣言法律治理考察及启示。对美国、德国、韩国、英国、印度 这五个国家的网络谣言治理进行介绍分析，吸收并借鉴其在网络谣言治理方面的可取之 处。 第四部分，完善我国网络谣言的法律治理。从立法、执法、司法、社会四个层面对 我国网络谣言的法律治理提出完善建议。提出要完善网络谣言法律治理体系和网络谣言 治理实施机制，在司法层面严格依法定罪量刑，并且加强自律机制，以此提高治理网络 谣言的效率。 关键词 谣言 网络谣言 法律治理 域外经验 I 河北大学硕士学位论文 Abstract The birth and development of the Internet technology, which has greatly influnced and changed the way of peoples lives, has provided convenience for the acquisition and dissemination of information.
