经典专科、本科、硕博、研究生、期刊毕业论文 仅供参考 精心整理 仅供参考 勿用作商业用途 关于文学作品著作权侵权标准的比较研究 【摘要】 中国内地和香港的文学作品的著作权侵权标准有相似之处，亦有不同。内地是“接触+实质性相似”，实质性相似的判断方法主要有整体观感法和抽象过滤分离法。具体到文学作品上如何判断实质性相似，则列举于正等与琼瑶侵害著作权纠纷上诉案进行阐述。香港是“复制+窃用作品实质部分”，其中“窃用作品实质部分”和“实质性相似”相似，但司法实践中对该标准的判断有所不同；复制分为直接复制和间接复制。通过对两地的著作权侵权标准进行比较，发现思想与表达二分法在两地的司法实践中都起了重要作用；接触标准和复制标准含义不同，反映其强调保护的内容和方向不同。两地的侵权标准各有优势，香港标准内在联系更加紧密，而内地标准则易于举证，能更好地保护著作权人利益。 【关键词】文学作品；侵权标准；思想与表达二分法 [Abstract] There are similarities and differences in the standards of copyright infringement of literary works in mainland China and Hong Kong. Methods of the mainland is contact plus substantial similarity, the substantive similarity judgment method mainly has the whole perception method and the abstract filtration separation method. Concretely to how to judge materially similar in the literature work, then enumerates present and so on the infringement copyright dispute appeal case to elaborate. Method of Hong Kong is copy plus the real part of the stolen works. The real part of the works is similar to substantial similarity , but in judicial practice they are different. Replication is divided into direct and indirect replication. By comparing the copyright infringement standards of the two places, it is found that the idea of ideology and expression dichotomy both play an important role in the judicial practice of the two places. The contact criteria and the copying standard have different meanings, reflecting their different emphasis on the content and direction of protection. The infringement standards of the two places have their own advantages. The internal standards of Hong Kong are more closely linked, while the Mainland standards are easier to prove and can protect the interests of copyright owners better.
