经典专科、本科、硕博、研究生、期刊毕业论文 仅供参考 精心整理 仅供参考 勿用作商业用途 论哈萨克族游牧民在迁徙中草原使用权的法律问题 摘要 哈萨克族是国内游牧民族。因为自然因素以及发展历程的影响，该民族在古代就随水草而生活，展现出游牧生产的特点，此类生活模式要求牧民需要随着牲畜开展季节性搬迁，哈萨克族每年居住在草原上的只有三个月，每年五月份上山，八月份就开始下山，草原使用时间短。草原还是牧民生活的主要基础，草原使用权导致使用权纠纷。只有不断完善草原法，才能充分发挥其应有的作用。 本文主要围绕草原使用权而展开，分析草原法中使用权的法律问题，探究解决对策。 文章第一部分介绍了我国哈萨克族游牧民草原利用概况以及草原使用权的概述，第二部分从对美国草原法的分析，得出对我国草原法中使用权的借鉴。第三部分论述了我国草原法中草原使用权的存在的问题。比如：草原使用权概念模糊、草原使用权性质难定、缺乏相应的设立程序和与草原承包经营权的关系模糊。最后一部分，结合我国草原使用权现状，对完善我国草原使用权的立法问题提出意见和建议。包括1、增大草原使用权的适用范围2、进一步明晰权属 3、建立和完善地方配套法律体系 4、完善草原法实施保障机制。 关键词：草原法使用权；草原法；完善； Kazakh On the Legal Problems of grassland use rights ABSTRACT Real right Law provide the grassland usage by the right of use of natural resources，and point out its contents is use and profit．The first part of the article introduces the general situation of the grassland utilization and the right to use grassland in the nomadic grassland of our country. The second part draws lessons from the grassland law in our country. The third part discusses the existence of grassland right of grassland in our country. For example: the concept of grassland use rights fuzzy, grassland use rights difficult to determine the lack of the corresponding set up procedures and grassland contract management rights fuzzy. The last part, combined with the status quo of grassland use rights in China, to improve the use of grassland in Chinas legislative issues and suggestions.
