论我国诉讼离婚标准的不足与完善———以郭某诉纪某离婚案为例-法学毕业论文-本科毕业论文-毕业论文 ——文章均为WORD文档，下载后可直接编辑使用亦可打印—— 　　摘要：离婚作为一种社会现象，其理由也不仅仅局限于感情这块领域。我国现行婚姻法中确立的以夫妻感情确已破裂作为诉讼离婚法定标准，把精神性质的感情作为诉讼离婚的唯一实体标准，不便实践操作，难以反映夫妻关系的全貌，也不能涵盖夫妻离婚的全部原因。婚姻关系破裂本身所具有的广泛的包容性，能比较全面的反映出导致夫妻间不能享有权利和履行义务的原因。它不仅能从理论上解决夫妻感情的消失与婚姻关系无法继续维持二者之间的辨证关系，而且能从实践上涵盖各种不同的离婚实际，更能反映离婚的全貌，解决现行立法存在的矛盾和不足。采用婚姻关系确已破裂作为离婚标准既体现了婚姻的本质，又涵盖了婚姻关系的全部内容，避免了感情破裂标准的局限性，是符合当代婚姻法制的发展潮流。 　　关键词：婚姻法；离婚标准；感情破裂；婚姻关系破裂；共同生活 　　Abstract: Divorce, as a social phenomenon, its reason are not limited to the feelings in this field. Chinas current in the marriage law of the establishment of couples have indeed broken as legal standard divorce litigation, the spirit of nature as the only feelings divorce litigation entity standard, the inconvenience to practice the operation, cannot reflect the whole face of the relationship between husband and wife, also can not cover the whole reason and divorce.
