如何保证和提高建设工程质量是关乎国泰民安的重点问题。FI前，国内工程 质量良莠不齐，工程监督由强制监理向非强制监理过渡作试点，工程质量保险虽 然有“建筑工程一切险、安装工程一切险、工程质量保证保险”等多种险种，它 只涵盖了工程项H在建造过程屮因自然灾害或意外事故而引起的所有损失。其他 因索，如施工材料、施工工艺、施工管理等造成的质量风险没有明确的指引，对 工程保修期过后使用寿命期内的质量风险有一个定性的（指“终身责任制”）， 但没有明确的定量约定。本文通过比较研究国内外建设工程质量管理体系、工程 监理制度、工程保险制度的现状和发展趋势，利用保险理论、博弈理论等理论对 建设工程质量保险制度进行分析。结合我国的实际情况，借鉴“机动车交通事故 责任强制保险”（简称“交强险”），提出“建设工程质量事故责任强制保险” （简称“建强险”）的理论，为我国工程质量强制保险制度体系的建立提供理论 研究基础和实证研究结果，在工程建设领域推行符合市场经济规律的风险管理制 度一-“建设工程质量事故责任强制保险制度”，以促进我国建设行业持续、健 康和快速的发展。 关键词：建设工程质量，工程监理，工程保险，交强险，建强险 Abstract How to guarantee and improve the quality of constructions is a key to insure the safety of a country and its citizens. At the present time, the quality of domestic constructions is uneven. Although insurance companies offer various kinds of construction insurances, they only insure against losses cause by natural disasters and accidents during the construction. For losses cause by constmction materials, technology and management, they lack a clear instruction. These insurance companies do declare that they are responsible for the risks when the after services expire (Lifelong Responsibility System), they do not clarify the number of years their insurances will cover. Based on the research and comparison of domestic and foreign management, supervision and insurances of construction, this essay analyzes the system of insurance of domestic construction, using the Risk Theory and the Game Theory .
