论证明责任的分配 王帆勋 摘要：证明责任，又称举证责任，其基本含义是，在民事诉讼屮，应当由当事人 对其主张的事实提供证据并予以证明，若诉讼终结时根据全案证据仍不能判明当 事人主张的事实真伪，则由该半事人承担不利的诉讼后果。证明责任的分配，是 证明责任制度的核心，也是理论研究最有争议的问题。我国的举证责任分配应该 从举证责任分配的价值出发，借鉴各种理论学说的优点，结合我国具体情况建构 适合我国的举证责任及其分配制度。本文旨在通过概念梳理、范式总结和价值论 证，提出一?个更规范、更有操作性、更符合保障人权需要的民事证明责任分配机 制。 关键词：证明责任 真伪不明证明责任分配 On the Assignment of Proof Responsibility Wang Fanxun Abstract: Burden of proof, also known as the burden of proof, its basic meaning is, in civil proceedings, he shall provide evidence of the facts and proved, if the proceedings are terminated according to the evidence of the case still can not identify the parties that the authenticity of the facts, the party shall bear the adverse consequences of litigation.
