1965年解决国家与他国国民之间投资争端公约 ConventionontheSettlement ofInvestmentDisputesBetweenStatesandNationalsof OtherStates DoneatWashington on 18March 1965 PREAMBLE TheContracting States Consideringtheneedfor internationalcooperation for economicdevelopment,andtheroleofprivate internationalinvestmenttherein; Bearinginmindthepossibilitythat fromtimetotimedisputesmay arisein connectionwith such investment between Contracting Statesandnationalsofother Contracting States; Recognizingthatwhile such disputeswouldusuallybesubjecttonationallegalprocesses,internationalmethods ofsettlementmaybeappropriatein certain cases; Attachingparticular importancetotheavailability offacilitiesfor internationalconciliation or arbitrationto which Contracting Statesandnationalsofother Contracting Statesmay submit such disputesifthey sodesire; Desiringtoestablish such facilitiesundertheauspicesoftheInternationalBank forReconstruction and Development; Recognizingthatmutualconsentbythepartiesto submit such disputestoconciliation ortoarbitrationthrough such facilitiesconstitutesabindingagreementwhichrequiresinparticularthat dueconsiderationbegivento anyrecommendation ofconciliators,andthat any arbitralawardbecompliedwith;and DeclaringthatnoContracting State shallbythemerefact ofitsratification,acceptanceor approval ofthis Convention andwithoutitsconsentbedeemedtobeunder any obligationto submit anyparticular disputeto conciliation or arbitration, Haveagreedasfollows: CHAPTERI International Centrefor Settlement ofInvestmentDisputes Section 1 Establishment andOrganization Article 1 (1)Thereishereby establishedtheInternationalCentrefor Settlement ofInvestmentDisputes(hereinafter called theCentre). (2)ThepurposeoftheCentreshallbetoprovidefacilitiesfor conciliation andarbitration ofinvestment disputes between Contracting Statesandnationalsofother Contracting Statesin accordancewiththeprovisionsofthis Convention.
