我国传统武术传承的民间法视角探究 Abstract：Traditional marital arts， whose enduring heritage and prominent spirit have shown the specific splendour of Chinese national culture， is an important form of non-material cultural heritage. To have a closer look at the heritage of traditional marital arts， it is easy to find that it is contained in the non-governmental management organizational system of Chinese traditional society， and it derives， develops and expands in the process of folk social order， wealth heritage and cultural process by families， religious groups and some other social organizations. The heritage of traditional marital arts is adjusted by traditional folk law， meanwhile creates its own heritage rules. With the impulse of modern social civilization， coupled with the intensified conflict between state law and folk law， the heritage of traditional marital arts encountered a crisis， and some of them even tend to fade away. It is an effective approach to enhancing the revival of marital arts culture by analyzing the heritage mechanism from the perspective of folk law， and exploring the new heritage mechanism. Key words：traditional martial arts； folk law； inheritance mechanism 傳统武术，是我国非物质文化遗产的一种重要形态，几千年来为我国人民锻炼身体或自卫御敌之用传习不断。传统武术历久的传承和凸显的精神展现了我国民族文化特有的光彩。在民国时期，国家积贫积弱，倡导国民“强身健体，救亡图存”，武术甚至被称为“国术”。在今天以“武”“侠”为核心的电影成为了中国特有的文化标签，可见，传统武术在我国文化组成中的重要地位。 1 传统武术传承的现代之“困” 细究传统武术的传承，作为国民强身健体、自我防御的一种方法或手段，为人所习，为人所享、为人所用，而人自身不是一个孤立的存在，其所“习、享、用”必然在一定的空间内完成，也就是说传统武术事实上容纳在中国传统社会的民间管理组织体系之中，即在家族、宗教团体以及一些其他社会团体管理相应的民间社会秩序、传承财富和文化进程中衍生、发展、壮大，其创造着自身的传承法则，在适应着传统社会民间法的调整，甚至其本身的传承法则也成为了民间法的组成部分。 中国传统社会是一个乡土社会、一个熟人社会，“乡土”“熟人”不是规则、制度的反面，其社会秩序治理模式或者其自我调适构建了规则。有学者认为“民间法是独立于国家法之外的，人们在社会中根据事实和经验根据某种社会权威和组织确立的具有一定社会强制性的人们共信共行的行为规范”。根据这个界定，从中国传统社会民间治理涉及的领域来看，其大致有以下几种分类：1）基于血缘原因产生的民间法，即家族家规；2）基于地域原因产生的民间法，即乡规民约等；3）基于调整行业或者领域群体内部权利义务关系而产生的民间法，即行业规则等。这事实上也指称了传统武术的基本生存空间。 在传统的农耕文明、小农经济、自然经济下，血缘、家族意识浓厚，家族技艺不容丢弃，其家族对于武术技艺的传承规则，从本质上就是宗族制度在传统武术领域的反映。当随着现代工业文明的到来、生产力的发展、科技的进步，如现代交通技术发展，使
