摘 要 近些年来，随着社会网络的快速进展，还有新兴媒体的蓬勃进展，以及社会媒体对家庭暴力案 件的多次曝光，反家庭暴力引起了广大人民群众的紧密关注和重视，人们开始深深的思考其中的原 因，开始从法律的方面去寻觅解决家庭暴力的方法。 因此，通过制定反家庭暴力法，爱护妇女、儿童等家庭环境中弱势群体的合法权益，是全世界当前 急需解决的事情。美国在反家庭暴力的立法和司法实践相对其他国家而言都是比较完善的，其也是 最早颁布专门的反家庭暴力法的国家。在2016年3月，对我国法治进程具有重要意义的《中华人民共 和国反家庭暴力法》被颁布实施，其是我国第一部专门的反家庭暴力法，但我国反家庭暴力立法中 仍然存在一些不足。本文旨在通过与各国的反家庭暴力法进行对比研究，从中得到相关的启发，从 而提出相关我国反家庭暴力立法司法实践的建议。 关键 ：反家庭暴力 家庭暴力 救济制度 立法建议 ABSTRACT In recent years, with the rapid development of social network, the vigorous development of new media, and the multiple exposure of social media to domestic violence cases, anti domestic violence has attracted the close attention and attention of the masses, people began to think deeply about the reasons, and began to find solutions to domestic violence from the legal aspect. Therefore, it is urgent to protect the legitimate rights and interests of vulnerable groups in the family environment such as women and children by enacting the anti domestic violence law. Compared with other countries, the legislation and judicial practice of American anti domestic violence is relatively perfect, and it is also the first country to promulgate special anti domestic violence law. In March 2016, the first special anti domestic violence law of the peoples Republic of China was promulgated and implemented. It is of great practical significance to the process of rule of law in China, but there are still some deficiencies in the legislation against domestic violence. The purpose of this paper is to make a comparative study with the anti domestic violence laws of various countries, and to get relevant enlightenment from it, so as to put forward suggestions on
