夫妻房产适用约定财产制的法律问题研究.pdf

摘 要 伴随着当前我国离婚率的不断提高,家庭财产纠纷问题也逐渐显现出来。一开始,对于夫 约定 共有财产这一形式是不被人们接受的,随着夫 间财产关系的复杂化,这种财产约定才慢慢被大家所 理解所认可。然而我国《婚姻法》第19条规定的夫妻双方约定共同财产制的内容过于简洁且不够明 确具体,这就导致了人们在实践中对这个财产制度的具体理解和法律适用问题产生了很多争议。 法院在处理不动产物权的变动规章的认定问题上,更是出现了三种不同的学说,分 是债权形式 主义说、债权意思主义说和非因法律规定行为的动产物权认定变动规章说,这极易导致一个法院间 对于同种物权案件出现不同判决的现象。 为了更加深刻地探讨夫 约定财产制中房屋这种不动产物权的有关问题，笔者收集了相关的 夫 约定财产案件、司法判例，以便能够更好地发觉问题所在。 关键词 ：夫 约定财产；房屋；不动产 Abstract With the continuous improvement of divorce rate in China, family property disputes have gradually emerged. At first, the form of joint property agreement between husband and wife is not accepted by people, and as the property relationship between husband and wife is complicated, this kind of property agreement is slowly recognized by everyone. However, the content of the joint property system stipulated in Article 19 of the Marriage Law of our country is too simple and not clear and specific, which leads to a lot of disputes about the concrete understanding of the property system and the application of the law in practice. In dealing with the change of real property rights in the court, it appears There are three different theories, namely, the formalistic theory of creditor's rights, the doctrine of creditor's rights and the rule of change of property right of movable property which is not stipulated by law. In order to discuss the real right of real estate in the property system of husband and wife more deeply, the author collected the relevant cases of husband and wife property agreement, judicial jurisprudence, so as to find out the problem better.
