高空抛物损害责任的确定及承担方式研究——以武汉“高空水泥块致女婴伤残”案为视角.pdf

摘 要 由于社会经济的快速增长，高层建筑物密度与高度不断增加，导致高空抛物致人损害的案件备 受社会关注。《侵权责任法》第87条的施行为高空抛物损害案件提供了明确的法律依据【1】。但是，在《 侵权责任法》实施后，高空抛物损害相 问题依旧没有得到有效解决，而且第87条立法理念方面存 在超越侵权法责任原则的情况，也由此引发了大量的争议。此外，法官在司法实践中对第87条进行 解释与适用的过程中，也面临着实体与程序方面的难题。因此，本文运用理论分析法、案例分析法 等方法，以武汉“高空水泥块致女婴伤残”案为视角，对高空抛掷物损害责任 定进行研究与分析。 本文共分为六部分，第一部分对研究高空抛物损害责任的背景、目的与意义进行概述。第二部分为 界定高空抛物损害责任的概念，并针对其特征进行总结。第三部分为对高空抛物损害责任的规范结 构进行深入研究与阐述。第四部分为2014年武汉“高空水泥块致女婴伤残”案件分析，结合案例对高 空抛物损害责任进行分析。第五部分为探究完善高空抛物损害责任的建议，为司法实践提供有效的 理论参考，进而更加有效的防范与减少高空抛物所产生的危害。第六部分为针对研究结果进行总结 分析。 键词 ：高空抛物 侵权责任 损害赔偿 加害人推定 ABSTRACT Due to the rapid growth of social economy and the increasing density and height of high-rise buildings, the cases of human injury caused by high-altitude parabola have attracted social attention. The implementation of the eighty-seventh article of the tort law means that there is a clear legal basis for the damage caused by high altitude throwing. However, since the tort liability law was put into effect, the problems related to high altitude parabolic damage have not been effectively solved, and the legislative concept of is beyond the liability principle of the tort law, which also caused a lot of disputes. In addition, in the process of interpretation and application of Article 87 in judicial practice, judges also face difficulties in substance and procedure. Therefore, this article uses different methods to research and analyze the liability for damage caused by high-altitude throwing objects from the perspective of Wuhan "high-altitude cement block causing female infant disability".
