中文摘要 当前，我国的道路交通安全形势十分严峻，而交通肇事逃逸致人死亡又是交通 肇事犯罪中的多发现象。近年来，交通肇事逃逸问题一直是刑事司法和刑法理论关 注的焦点问题。由于我国刑法以及最高人民法院的司法解释关于交通肇事逃逸的相 关问题规定不明，有的规定与现行刑法规定和刑法理论相冲突，理论界分歧很大， 司法实践中处理此类案件又极不统一。针对交通肇事逃逸理论中存在的诸多争议问 题，本文即试图根据我国刑法理论并结合司法实践，首先对交通肇事逃逸致人死亡 的探讨意义性质进行剖析，进而分析了交通肇事逃逸致人死亡的主观方面，在此基 础上，对交通肇事逃逸致人死亡的定罪分析进行了系统的研究，并提出了在交通肇 事逃逸致人死亡方面的立法完善的观点和建议。 关键词： 交通肇事；交通肇事罪；逃逸致人死亡 I Abstract At present, the situation of road traffic safety in China is extremely grim. Among all the traffic accident crimes, the most common one is the death caused by hit-and-run accidents. In recent years, the problem of hit-and-run accidents has been concerned in criminal justice and the theory of criminal law. In fact, the relevant rules about hit-and-run accidents from our criminal law and the judicial interpretation of the Supreme People ’s Court are not clear. There is a conflict between some rules and the current criminal rules, as well as the theory of criminal law. In the theory horizon, the difference is great. And in judicial practice, there is no unitary way to deal with these cases. In allusion to the numerous disputes in the theory about hit-and-run accidents, this thesis aims to analyze the explore significance and the subjective element and the objective element of the death caused by hit-and-run accidents, according to the theory of criminal law and the judicial practice. Based on this, it makes a systematic study on the conviction of hit-and-run accidents and provides somesuggestions to perfect the legislation in this respect.
